Research On The Collaborative Model For Consumer Rights Protection

In recent years,with the rapid development of commodity economy,a variety of new consumer disputes have emerged,which has created new issues of consumer rights.To better protect the rights and interests of consumers and maintain market order,it is urgent to build a legal,efficient and stable model of rights protection.Collaborative governance theory can be applied to construct the model of consumer rights protection.When protecting the consumers' rights,the multi-subject and the common goal are meet the features of the collaborative governance,on the other hand,the collaborative governance provides a new theoretical for the coordination and collaborative model.Taking Wuxi city as an example,the existing mode is: the government playing a leading role;social organizations,consumers,operators and the mass media taking a supporting role,and the government cooperating with these other subjects.This model has been unable to adapt to the new situation of consumer rights protection.Analyzing the defects of the system and mechanism,and the causes of these defects,the collaborative model should be an inevitable choice.Comparing foreign experiences,we should re-position the role of five subjects including the government,social organizations,consumers,operators and the mass media,put forward the collaborative factors: trust,legal and information,and construct the collaborative model,which should improve the legal system,build a sharing integrated information platform,and establish legal and efficient mechanism to solve the problem.The mechanism is namely to improve the legal and related policies,build a comprehensive information sharing platform,and establish a legal and efficient mechanism to solve the problem,including consumer disputes mediation mechanism,supervision and feedback mechanism,and contingency plans for unexpected and group incidents.
