Local Protectionism Evasion And Governance Research In Government Procurement

The government procurement system originated in the United Kingdom at the end of the 18th century.With the reform of China's fiscal system,government procurement has become an important part of the state's fiscal expenditure,and plays an important role in the government's macro-control and policy functions.The promulgation of the "Government Procurement Law"(2003)and the "Regulations on the Implementation of the Government Procurement Law"(2015)further regulates the development of government procurement in China,and the scale of government procurement is also growing.In 2017,the scale of government procurement in China has been breaking through 3 trillion.However,the development of government procurement has also exposed a series of problems.More than 90%of the procurement funds are controlled by local governments.The leverage effect of government procurement has also evolved into a means for local governments to promote development and maintain growth.The phenomenon seriously hinders the establishment of a unified market for government procurement in China and restricts the healthy development of government procurement.At the same time,China is also facing the GPA agreement and multilateral multilateral agreement to join the WTO,and the pressure to integrate with international government procurement.It is imminent to crack the local protectionism of government procurement.In local government procurement,its protectionism also manifests itself in various forms and is relatively concealed.For example,local laws and regulations have legalized the illegal system,partial disclosure of procurement information,increased access threshold for foreign suppliers,implementation of preferential policies for local enterprises,and fiscal subsidies,interest groups of localgovernments and enterprises,etc.Based on the development process of China's government procurement system and the background of the new era,this paper first expounds the status quo,manifestation and harm of local government procurement in China,and then deeply analyzes the internal system defects and external environmental pressures.And by drawing on the experience of the EU to establish a regional integrated government procurement market,it provides effective advice to evade the government's procurement of local protectionism.The article is divided into six parts:The introduction part first expounds the development background and the new era task of China's government procurement,and draws the meaning of this topic.Then it makes a comprehensive summary of the domestic and foreign research on local procurement of government procurement,pointing out the innovation and inadequacies of this paper.The first part is mainly a theoretical analysis of local protection of government procurement.This part mainly defines the concept of government procurement local protection,regional market integration and government procurement coalition,and further elaborates the theoretical framework for evading local procurement of government procurement.The second part consists of two levels.It analyzes the current situation of local government procurement in China.Taking the phenomenon of drug purchase exclusion in Sichuan Province in recent years as an example and comparing the rectification before and after,it summarizes the main manifestations and harms of local government procurement.The third part analyzes the inducing factors of the local protection phenomenon of government procurement in China from the internal and external perspectives.The internal system defects are mainly reflected in the imperfect government procurement laws and regulations,the failure to implement accountability,the opaque information disclosure,and the failure of supplier rights relief.From the external incentives,it is mainly due to the competition and performance evaluation of local government political tournaments,caused by an unscientific and imperfect fiscal decentralization system.The fourth part takes the EU to build an integrated regional government procurement market as an example.It analyzes the external system foundation and the experience of avoiding the procurement barriers of member states.At the same time,it points out the shortcomings in its operation for reference.The fifth part proposes the construction of China's unified government procurement market from three perspectives,and evades the relevant countermeasures for government procurement local protection.The first is to improve the internal system construction of government procurement operations,the second is to eliminate the external pressure generated by local procurement of government procurement,and the third is to develop corresponding supporting measures,such as the implementation of government procurement regional alliances,and encourage the development of government procurement intermediary service agencies.
