Lacking of capacity in the risk control is the common problem of China's domestic enterprises,especially in the equipment manufacturing industry,this weakness is particularly evident.As a traditional industry,the equipment manufacturing industry generally doesn't have enough knowledge in the contract risk management,it has no idea about what elements will affect or restrict the business operating,it lacks of systematic,complete and workable legal risk preventing and coping mechanisms,in operation process it cannot promptly and effectively identify,analyze and prevent risk,and therefore often suffers unnecessary losses and has to pay for the loopholes in management.In fact,legal risk associates with the whole process of the enterprise's management activities,as long as an enterprise has operating activities,the legal risk cannot be avoided.The management and control of legal risk is a long and complicated work.The core value of the enterprise's legal management work is not to resolve disputes,but to control and resolve legal risk.How to effectively carry out the contract risk management,to detect and defuse the risk of the contract is the purpose and significance of this paper.Company M which appeared in this paper is one of the large domestic listed state-controlled enterprises,and is also the leading enterprise in the industry which holds a very influential position in the global equipment manufacturing industry.This paper uses disputes arising in the business developing process of the company as cases.Firstly introduces the connotation of the concepts of contract risk management,and states the characteristics,describes several important stages of contract risk management system's constitution.Secondly offers case's descriptions of company M's contract disputes.This article introduces several aspects,such as the conclusion and performance of the contract,sale services,treatments of quality problems,all aspects of escalation of contradictions,case's situations,as well as the impact on company M,etc.Then uses the theory of contract lifecycle management,combine the four-stage theory of risk identification,evaluation,implementation control and evaluation control together to analyze the risk management issues for the case.Finally sums up experiences and lessons of case,and then draws the conclusions of this thesis.This paper uses several cases to expose various problems appeared in the contract risk management process.The cases appeared in this paper are very particular which can dynamically reflect the real situation of company M's management.And these cases also have practical significance for the prevention and control work of the company's contract legal risk management.From the general sense,this paper has certain reference values for the manufacturing industry,or other industries' legal risk management works.
