Research On Negotiation Mechanism Of Enterprise Employment Adjustment Under The New Normal

At present,the speed of China's economic development is slowing down,and new problems appear in the production of enterprises.Under the influence of the new normal economy,some enterprises have employees surplus,while some enterprises have labor shortage phenomenon.In order to solve the labor shortage problem and adjust the enterprise surplus,some local enterprises spontaneously carry out the employment adjustment in production seasons,i.e.enterprises with less production orders lease his surplus labor to the enterprises which lack for employees but have many orders.The author call this employment secondment method"enterprise employment adjustment".The main research methods in this paper are field research and literature research.Literature research is retrieving the research results of flexible labor or informal labor relations at home and abroad as a reference.Field research is carrying out the labor adj ustment of enterprises and industrial area in Fuzhou,Xiamen,and other places of Fujian province.The interviewees mainly include people in charge of the enterprise,the staff,the person in charge of the administrative committee of the industrial zone,the person in charge of the information platform of the community employment and so on.The survey found that those leased employees' labor relat:ions is still in their original enterprise in enterprise employment adjustment,that social insurance,service award,attendance award are still paid by the original enterprise,and that employee input production workers are responsible for the payment of wages during the dispensing and bear the responsibility for work-related injuries,transportation etc.The independent employment among enterprises at present mainly occurs in Jinjiang district of Fujian province.In addition,other forms of employment adjustment are appeared in Fujian province,"School enterprise employment swap cooperation,"village enterprise cooperation mode" of Nan ping city respectively.The three kinds of labor adjustment are the typical labor adjustment modes in Fujian province.The employment adjustment action effectively solves the problems of surplus and insufficient employment in the production season,reduces the labor cost of enterprises,improves the income of employees,and stabilizes the staff of enterprises at the same time.There are some urgent problems to be solved in the adjustment of enterprise employment.First,the leased employee's identification of labor relations are not consistent with the laws.Second,the dispute about the leased employee's occupational injury still exists.Third,the leased employee's social insurance payment is not clear and some other problems remain to be solved.Fourth,The working environment and payment level differs are likely to lead to the leased employee' s turnover.Fifth,perfect complementary can not achieve due to the cooperative enterprises' different dispensing time.Sixth,the overall lack of employee leads to enterprise employment adjustment is difficult to carry out etc...In order to help enterprises solve the problem of labor shortage and recruitment difficulties,and to make " labor transfers " much more positively and effectively carried out in all walks of life,the following points should be completed:first,some problems among the employment adjustment and the leased employee's labor relations must be clearly defined.Second,the government should help build autonomous docking platform,which enables the employment adjustment to be carried out more orderly;Third,to prevent disputes caused by industrial injury and labor trouble,the dispute resolution mechanism above labor adjustment should be established.Fourth,the social insurance payment mechanism about the leased employees should be established,and to guarantee the rights and interests of the leased employee,the temporary safeguard mechanism of employment adjustment should also be established.
