Female employment has been a worldwide topic. With the development of China's market economy, more and more women have participated in the labor force market. However, because of the physical gap between men and women bear with them, the weak position of women in employment and occupation has been becoming increasingly clear. It is a mirror of this issue that female college students facing discrimination in the course of employment based on gender. China has established a lot of laws and regulations on the protection of rights and interests of female employment and occupation.However, because of legal issues and their problems in the implementation process; the law in practice did not really play a very good protection role. In this paper, we base on the instance in our country, and learn from foreign experience in this area to improve our legislation.This total is divided into four parts.The first part is the summary of this article. It introduces some basic concepts, including employment, occupation, employment discrimination and equal employment rights. Protection of women's employment and vocational interests is not a simple problem, and it has a profound theoretical connotation. It is the means to protect women's basic rights, is the need to achieve women's basic values, and accord with the basic concept of economic law.The second part introduces practices in the protection of women's employment and occupation in foreign countries. Western countries started market economy earlier, so the legislation in this area started earlier and is relatively more mature. This article focuses on the legislative, law enforcement agencies and relief in the protection of women's employment and occupation of Germany, Japan and the United States.The third section introduces the present situation on protection of women's rights and interests in employment and occupation in our country. This part introduces the rules of law in protection of women's rights and interests in employment and occupation; all kinds of employment discriminations in women's employment and occupation and the reasons for the above-mentioned phenomena, including social attitudes reason and the reason that the law is too principled, lack maneuverability and exist dead zone.For the above reasons, we learn from the advanced experience of foreign countries to improve our country's laws in part four.
