The 19 th National Congress of the Communist Party pointed out that "the main contradiction of our society has been transformed into a contradiction between the people's growing need for a better life and the development of an imbalanced and inadequate development." This contradiction is particularly evident in the urban and rural land system,and the supply and demand of urban and rural construction land.Mismatch,inefficient use,and inequality of rights not only cause waste of land resources,but also become an institutional barrier that restricts rural revitalization and new urbanization.In August 2017,the State issued the “Pilot Program for the Construction of Leased Housing by Collective Construction Land”,which is another major reform and deployment of the central government focusing on the overall development of rural revitalization strategy and new urbanization,and establishing a sound and stable real estate.It is of great significance to develop long-term mechanisms,promote the optimal allocation of collective land,and broaden the channels for collective economic organizations and farmers to increase their income.Based on the existing research,this paper uses the theory of land property rights,the theory of push-pull and the theory of new institutional economics,systematically sorts out the policy changes of collective land transfer and leased housing construction,and grasps the institutional reform direction of collective land development and rental housing;in the framework of policy change Next,analyze the market system and participation behavior of collective construction land to develop rental housing,and clarify key factors such as market related entities,trading rules and rental income distribution;based on the multi-complexity of market participants and the multi-party interests,from collective construction The dilemma faced by the experience of land transfer into the city's pilot policy,the urban-rural dual land system,the trading mechanism and the construction and operation of rental housing;the existing obstacles and the predicament,from the urban and rural construction land market,the government-enterprise cooperation management mechanism Suggestions for countermeasures such as coordinating land supply models and safeguard measures.The main conclusions of this paper are as follows:(1)From the implementation subject,the leasing entity,the government and the enterprise,etc.,to clarify the relevant main body positioning of the collective construction land to develop the leased housing,and formulate the lease rules from the multiple ways of entering the market for the collective construction land and the lease relationship of the tenant.It is necessary to realize the general balance of land value-added income obtained by the state,collectives,and peasants in the development of leased housing in collective construction land,which can be solved through two ways: improving land acquisition compensation and raising land appreciation income adjustment funds.(2)The scope of the object of the collective construction land transfer pilot area is not uniform,the registration of the power is inconsistent,and the transfer method is different,which leads to the immature policy promotion.Incomplete property rights of collective construction land have led to the development of rental housing subject to legal restrictions.The unsound development of the collective construction land market is mainly characterized by irregular circulation prices,unrecognized value-added income distribution systems,and high use supervision costs.The construction of collective rental housing is also plagued by shortage of funds and lagging rent recovery.(3)The collective construction land should be given the same rights as the state-owned construction land,and the diversified land supply for residential land should be promoted,and the value-added income of the land should be rationally distributed.Strengthen cooperation between government,collective and social capital,rationally distribute rental income,promote the construction and operation of collective construction land leased housing,and ensure multi-party interests through strict procedures management and property rights confirmation registration.The construction of leased housing land is provided in a multi-faceted manner from the vacancy of the homestead,the village co-ordination,and the township regional co-ordination.
