Japan,which owns most of the core patents of rare earth permanent magnet materials in the world,carries out large-scale cross-licensing of patents around the world by virtue of its patented technology,and carries out strict patent protection for itself,at the same time,it has built a solid patent barrier for Chinese rare earth permanent magnet enterprises.Japan's rare earth patent barriers force Chinese rare earth permanent magnet enterprises to export the rare earth permanent magnet materials to the countries that have applied for patents only by paying high patent licensing fees or reselling the products below market prices.Due to the lack of technical strength or correct understanding of foreign patent layout,China's rare earth permanent magnet enterprises are restrained everywhere in the face of patent barriers,and the development of China's rare earth permanent magnet enterprises abroad is delayed.Japan's rare earth patent barrier is the biggest obstacle for China's rare earth permanent magnet enterprises to achieve large-scale expansion and enter the international high-end market.In this paper,the impact of Japan's rare earth patent barriers on China's export of rare earth permanent magnet materials is taken as the research object.According to the inherent logic of the development of patent barriers,the current situation and existing problems of China's rare earth permanent magnet enterprises encountering patent barriers are sorted out,and the formation mechanism and impact of Japan's patent barriers are analyzed.Combining with the case of patent barriers encountered by Chinese rare earth permanent magnet enterprises at present,the paper summarizes the costs and gains that rare earth permanent magnet enterprises should pay for patent barriers,and analyses the optimal decision-making of Chinese rare earth permanent magnet enterprises under different circumstances.This paper constructs a linear regression model based on relevant data to empirically study the impact of Japanese patent barriers on the export of rare earth permanent magnets in China.The empirical results show that the amount of rare earth permanent magnet patents filed by Japan worldwide has a significant inhibitory effect on the export of China's rare earth permanent magnets,and the number ofapplications filed by China's rare earth permanent magnets has a positive effect on the export of China's rare earth permanent magnets.However,the data comparison shows that the role of Chinese rare earth permanent magnet patents in breaking through patent barriers is not strong,which reflects to a certain extent the low level of patent technology of Chinese rare earth permanent magnet enterprises and the immature mastery of patent system.The ability of rare earth permanent magnet industry to use patents as a breakthrough patent barrier needs to be improved.On the basis of case study and empirical analysis,this paper puts forward feasible countermeasures and suggestions for Chinese rare earth permanent magnet enterprises to break through Japanese patent barriers: promoting the diversification of rare earth industry policy;following closely the adjustment of development strategy of rare earth permanent magnet application powerful countries;promoting the linkage development of rare earth permanent magnet related industries;enhancing the patent protection awareness of rare earth permanent magnet enterprises;and exporting rare earth permanent magnet materials to destination countries.Patent layout should be carried out ahead of time;a special strategic alliance for technological innovation of rare earth permanent magnet industry should be established;the government should set up relevant departments to protect rare earth patent property rights;actively participate in the formulation of international standards,attach importance to patent issues in standards;and strengthen basic research work on innovation of rare earth permanent magnet materials.In order to avoid the patent barriers faced by China's rare earth permanent magnet enterprises,the patent technology level of China's rare earth permanent magnet enterprises should be improved as a whole.
