China has implemented a no-fault employer responsibility system for occupational injuries in high-risk industries,employers need to evade their own liability risks,or the government takes measures to ensure that employers can fulfill their liability for compensation.There will be a series of risk management arrangements,and insurance is the main means of risk transfer and dispersion that is generally accepted by people.At present,China has two types of insurance for transferring employer liability risks,one is work injury insurance,and the other is safety production liability insurance implemented by the Safety Supervision Bureau in the pilot area.China’s industrial injury insurance has been implemented for a long time,and safety production liability insurance,as a new type of insurance that has just been introduced in the field of work-related injuries,has shifted the liability risk of enterprises in terms of labor compensation,and it is worthwhile to reduce the burden on employers.The research on China’s safety production liability insurance mainly focuses on the reasons for the slow implementation of insurance and the improvement of the system design of safety production liability insurance.The above research only analyzes the implementation of safety production liability insurance from a theoretical level,and does not further analyze the degree of transfer of safety production liability insurance to employer liability risk and the actual reasons behind the results.Based on the introduction of research methods and basic theories,this paper measures the degree of transfer of occupational injury insurance and safety production liability insurance system to employer’s occupational injury liability risk from the policy level and quantify the transfer of the two types of insurance in the employer’s liability risk.Then,in-depth enterprise investigation,use case study to analyze the current situation of risk transfer of safety production liability insurance for non-coal mine enterprises,and further confirm the theoretical responsibility of risk transfer of safety production liability insurance.And through the interviews with stakeholders,the cost-benefit analysis framework is used to further explore the reasons for the risk transfer of employer liability risk in the aspect of work-related injury insurance,making it more convincing.Finally,on the basis of the original research,the suggestions and countermeasures for improving the design of the safety production liability insurance system are proposed.The study concluded with the following conclusions:For enterprises that have already participated in work-related injury insurance,the safety production liability insurance does not compensate the medical treatment and death benefits of employees who are injured or injured in work.Due to the lack of design of the insurance system,enterprises can not obtain the compensation transfer of insurance companies in the treatment of disability.Therefore,the safety production liability insurance does not transfer the liability risk of the work injury insurance to the risk transfer of corporate responsibility.The effect of the implementation of the safety production liability insurance is contrary to the original intention of the safety supervision bureau to implement the insurance.The reason is that enterprises,insurance companies and safety supervision departments will make different behavior choices under their compulsory safety production liability insurance system for their respective cost-benefit considerations.Due to the homogeneity of occupational injury management and the consistency of risk management system in high-risk enterprises,the conclusions reached by the above-mentioned case enterprises can be extended to high-risk enterprises across the country.
