Research On Intellectual Property Protection Of Cross-border E-commerce

After entering the era of "Internet +",the development of cross-border electricity providers is very fast.Cross-border e-commerce has the characteristics of global forum,invisibility and Paperless.With the rapid development of digital economy,cross-border e-commerce breaks the barriers of national boundaries and makes international trade go to cross-border trade.As a new form of foreign trade,cross-border e-commerce has played an important role in promoting trade globalization,causing tremendous changes in global economy and trade.However,intellectual property infringement incidents occur from time to time,such as "Amazon Balance Car Undercarriage Incident","fingertip Series Incident" and "337 investigation of mobile phone bracket",which hinder the further development of cross-border e-commerce.At present,more and more countries recognize the importance of doing a good job of intellectual property protection,and strengthening intellectual property protection will have greater competitive advantages.Many countries,especially developed countries such as the United States and Japan,have raised the issue of intellectual property protection to the height of their national development strategies.Strengthening intellectual property protection has become an important strategic measure to gain and maintain international competitive advantage.Intellectual property plays an important role in the sustained growth of a country's economy and the improvement of its competitiveness at the international level.In this context,how to strengthen the protection of intellectual property rights in cross-border e-commerce has become an important issue that scholars pay close attention to.It is of far-reaching significance for all countries and enterprises involved in cross-border e-commerce to study the development trend of international intellectual property protection and formulate and implement relevant intellectual property protection measures in order to effectively protect national technological security,promote enterprises' independent innovation ability and safeguard their own economic interests.This paper aims to study the problem of intellectual property protection of cross-border e-commerce and related countermeasures.Starting with the introduction of related concepts of cross-border e-commerce and intellectual property protection,it illustrates that cross-border e-commerce is closely related to intellectual property protection.The development of cross-border e-commerce is rapid,and some traditional theories and practices of intellectual property protection can no longer meet the requirements of development.Next,it introduces the development status of cross-border e-commerce and the status of intellectual property protection,and illustrates the seriousness of intellectual property infringement in the exchange on the business platform.This leads to the focus of this article,namely,in-depth discussion and Research on the protection of intellectual property rights in cross-border electricity providers,and then discusses the copyright,trademark and patent infringement risks in the cross-border e-commerce transactions,and analyzes the three cases of "piggy page" copyright infringement,"UGG" trademark infringement case and Amazon balance vehicle.Then it analyses the reasons for the infringement of cross-border e-commerce.Finally,based on the above analysis and research conclusions,from the international level and the domestic level,the paper puts forward policy recommendations to promote the construction of intellectual property protection of cross-border e-commerce in China,which can be used for reference by government decision-making departments and cross-border e-commerce.
