Abstract/Summary:
In recent years some Indian tribes have experienced rapid economic growth. As a result, having well-developed tribal judicial systems has become an important factor in sustaining tribal economic development. Generally, tribes are not prepared for the impact on tribal judicial systems brought about by rapid economic growth. Some tribal courts are unprepared to handle increased caseloads, challenges to tribal court jurisdiction and have inadequate laws to handle complex business litigation. This thesis explores the impact of economic growth on three tribal judicial systems. Other related issues are discussed such as the importance of developing independent judiciaries, tribal bar associations, and tribal commercial codes.
