Abstract/Summary:
Homosexuals are identified as a new class of domestic violence subjects under the New Jersey Prevention of Domestic Violence Act of 1991. Homosexual households consisting of children, the biological/legal parent and the non-parent lover are commonplace. Domestic violence committed by the parent renders the household dysfunctional, however the non-parent has no legal parent/child relationship to claim temporary custody.;The thesis suggests subjective and objective standards that would allow the court to adjudicate temporary child custody to the non-parent victim.
