Abstract/Summary:
This thesis is a comparative study between Chinese law of secured transactions in properties other than immovable and North American personal property security legislation, with a view to explore the possibility for China to adopt the PPSA system in North America.;This thesis starts with tracing the traditional security devices in China before the communist regime; it then analyzes the reason why the security law was absent from China for thirty years and why the system is desirable for China today. The thesis also examines the China's security law in detail and criticizes the flaws of the system, and further discusses the feasibility to adopt some of the techniques in Article 9 type security laws. Finally, the thesis concludes that the adoption of modern security law is desirable and feasible for China's economic modernization.
