Since 1984,when China enacted the Patent Law of the People's Republic of China,it marked China's entry into the sequence of intellectual property protection countries.With the country's continuous attention to scientific and technological innovation and strengthening awareness of intellectual property protection,China has become an important intellectual property country.Since the revision of Article 6 of the Patent Law of the People's Republic of China,especially in the public ownership-based state government-enterprise pattern,the company as the main body of intellectual property rights ownership,job invention is particularly important in the status of the company's intellectual property protection system,so the study of job invention and its rights and interests distribution has certain value and reference significance in the current intellectual property research system.The research content of this paper includes a tobacco company job invention rights allocation mechanism as the research object,to combine the actual situation of company S to job invention rights allocation mechanism for reasonable optimization of the research problem.Patent information search was conducted in inco Pat patent database to collect patent data information for analysis,while the research method of semi-structured indepth interview was used to investigate the interviewees,including the leaders of each division of Company S,the general manager of the subsidiary,the R?D backbone of the subsidiary,and the grassroots employees of the baking tobacco factory.The research was conducted on the structure of Company S,business layout,job invention creation system and its implementation,and internal improvement proposals of the company,etc.By combing the theory of job invention,a scientific and fair value evaluation system was established,and the standard and mechanism for distributing the rights and interests of job invention were clearly formulated to guarantee the implementation of the system to reach the target.The features of the mechanism for distributing the rights and interests of job invention proposed in this paper: First,the contribution degree of Company S's inventions are classified according to the innovation classification and the innovation stage;second,the fair and reasonable amount of equity distribution of Company S is calculated by the QC method of job results transformation,which multiplies the economic value by the contribution degree,minus the loss arising from the fault of related parties;third,the equity distribution system of Company S,which combines reward and compensation,needs to consider three dimensions;the company management,core employees,policy system,specifically for the promoter incentive,so as to balance the internal interests of the company;Fourth,the system effective implementation of the guarantee from the implementation and adjustment of the three aspects of the agreement process,promotion reward system,financial budget system corresponding planning.
