A Study On The Improvement Of Legislation On The China’s National Park Management System

In 1872,the United States built the world’s first national park,which effectively achieved the balance between the protection and utilization of natural resources.Based on this,national parks have gradually become an ecological management model recognized by the international community,and then began to be implemented in many places around the world.At the Third Plenary Session of the 18 th CPC Central Committee,it was proposed for the first time that China should realize the construction of the national park system,which was also regarded as a key task in the comprehensive deepening reform.With the release of the overall plan on the development and management of national parks(hereinafter referred to as "overall plan")in 2017,the direction of the national park system reform has been clearly defined,which marks the preliminary completion of the top-level design of the national park system.At present,the pilot work of the national park system is progressing steadily,and it has gained a stage achievement;nevertheless,there are still some difficulties and problems that cannot be ignored.For example,the national park management system is still in the exploration stage;therefore,it has not yet straightened out the authority relationship between central government and local government.Besides that,it also lacks corresponding system norms.This paper first fully affirms the positive significance of national parks as the core content of the reform of ecological civilization system,which is an important measure made by the Party and the state in the new historical period.In the meantime,it combs the present situation of the existing natural reserve-based natural protection management system in China,and expounds its shortcomings and the positive impact of constructing a new scientific national park management system.Secondly,on the basis of the research on the advanced experience of the national park management system of foreign countries,this paper summarizes the advanced experience and methods worthy of China’s absorption and reference through the comparison of horizontal and vertical dimensions.Finally,according to the actual situation of our country and the guidance of national policy,starting from the necessity and feasibility of perfecting the management system,this paper puts forward some countermeasures and suggestions to construct the national park management system in China.
