Research On The Licensing System Of National Parks In China

The principle of green development defines the goal of strict protection and scientific utilization of national parks,and the franchise system of national parks in China is an important embodiment of the principle.Eleven pilot national parks in China have established franchise system according to the requirements of the guidance on the establishment of National Park based nature reserve system.The grant and acquisition process of National Park franchise usually includes three stages: license,contract and operation.Based on the rights and obligations of both parties in the licensing stage,the author thinks that the National Park franchise license belongs to the administrative license.However,China’s National Park franchise license system has some problems,such as the unclear access conditions,the lack of scientific concession period and the difficulty to implement the legal responsibility.Therefore,based on the status quo of legislation and practice of National Park franchise license system,this paper studies the subject,scope and legal responsibility of National Park franchise license based on the principle of green development,so as to provide suggestions for the improvement of the system.This paper is divided into five parts.In addition to the introduction of the first chapter and the conclusion of the fifth chapter,the main content of the paper consists of the following three parts: the second chapter,based on the definition of National Park and National Park franchise license,explains the nature of National Park franchise license,and combines with the current situation of legislation and practice of National Park franchise license in China,This paper analyzes the problems in the legislation and practice of National Park franchise in China.The third chapter mainly studies the theoretical basis of the National Park franchise license in China.Based on the analysis of the traditional legal values of efficiency and fairness,freedom and order,combined with the goal of national park construction,it puts forward the new legal basis of National Park Construction: the principle of green development.Under the guidance of the green development principle,the fourth chapter puts forward some suggestions on the optimization of the National Park franchise license system in terms of the subject,license scope and legal liability.
