Research On The Construction Of The National Park Franchise System In China

Nature reserves have become the core of national ecological construction.As one of the main types of nature reserves,national parks have begun trial construction in China,supported by a series of national policies,and also introduced a number of local regulations.As an important part of the legal system of nature reserves,national park legislation should mainly include management mechanisms,legislative models,and legal systems.This article will study the franchise system at the legal system level.Franchise has been widely recognized since its birth in the United States in the 19 th century,and national park franchises in many countries have achieved remarkable results.In China,the construction of franchise systems in existing nature reserves and scenic spots is not complete,and problems such as unclear rights and responsibilities,multiple management,and flooding of projects have emerged.National parks also have problems in franchising practices where the scope of franchising is vague and related income cannot be fed back to surrounding communities.In order to avoid similar problems,when establishing the national park franchise system in China,we should combine domestic and foreign experience to find a development path suitable for the national park franchise and promote the improvement of the legal construction of national parks and related nature reserves.The research in this paper uses literature analysis,empirical analysis,and comparative analysis.The thesis mainly discusses from four aspects: First,the connotation of the franchise and the national park is clarified,and the importance of the franchise operation in the national park is clarified.Secondly,it analyzes the problems in China's national park pilot practice and legislative attempts.Third,analyze the development experience of national park franchise in four typical countries,and summarize the inspirations applicable to the construction of national park franchise system in China.Finally,starting from the construction of the national park franchise system,the principle of the national park franchise system in China is explored,and the three-power separation system,access system,contract review system,public participation system,and supervision system of the national park franchise system are constructed.Through the above research,the basic content of the construction of the national park franchise system is explained,and the establishment of the national park franchise system can play its due role to achieve the purpose of protecting the ecological environment and improving human welfare.
