| Arbitration Law of the People’s Republic of China amended in 2017 and the rules for arbitrators formulated by local arbitration institutions have provided the most basic codes of conduct for arbitrators,which has played an important role in strengthening the management of arbitrators and the construction of professional ethics.However,for the construction of arbitrators’ professional ethics,there is still blank space of specialized national professional ethics.Moreover,in some specific provisions,the content is not specific,lack of operability or corresponding cohesive mechanism.Therefore,the translation and research of professional ethics of arbitrators in foreign countries is urgent.This translation report is based on English-Chinese translation of Ethics Standards for Neutral Arbitrators in Contractual Arbitration.The translator takes Susan ?ar?evic’s Legal Text Typology and Legal Equivalence as main theoretical guidance,combining professor Li Kexing’s Six Practical Principles in Legal Translation from three levels: textual level,syntactic level and lexical level,to solve specific problems,and discuss translation methods and techniques.Firstly,the translator starts from the type of source text and realizes that the source text,as rules of court,should be classified into the category of “primarily descriptive” according to Legal Text Typology put forward by ?ar?evic.Correspondingly,the analysis of key and difficult points by the translator is also carried out from textual level,syntactic level and lexical level.At the lexical level,this paper focuses on the incongruency of three types of legal terms: near equivalence,partial equivalence and non-equivalence.In the case of near equivalence,equivalents are used;in the case of partial equivalence,lexical expansion is adopted;in the case of non-equivalence,descriptive paraphrases,definitions,neutral terms,borrowings,literal equivalences or other neologisms are used.At the syntactic level,the translator analyzes the translation of long sentences and difficult sentences.At the textual level,the author analyzesdifferent formulaic languages and text structures.Through this translation practice,the translator realized that normative legal texts are professional,rigorous,normative,and authoritative.Diffficult sentences are often used,and discourses are formulaic.The translation of this type of legal text should aim at achieving equivalence of text content or meaning,intent,and legal function between the source text and the target text.It should be based mainly on literal translation method,and supplemented by other translation techniques.The general principles for evaluating the translation of such legal texts should be accuracy and precision,consistency and identity,clarity and conciseness,professionality,standardized language,back translation and team work. |
