In modern society,human rights have always occupied an important position,and have been widely used in almost all fields such as economy,politics,education,and medical and health care.However,human rights theory always has the problem of weak ideological foundation.As a result,Sen rethinks the issue of human rights and constructs a unique theory of human rights.Sen believes that human rights are a kind of moral rights,and what it focuses on is freedom with moral and social importance.Sen believes that freedom contains two most basic aspects,namely the process aspect and the opportunity aspect.He bases the feasibility of human rights claims on the basis of public rational deliberation.On the one hand,he responded to people’s doubts about the lack of rational basis for human rights;on the other hand,he established a human rights theory of “Capability”,which focuses on people’s capability on realizing their cherished life,and ultimately points to the realization of human rights,providing us with a new way of thinking about human rights issues.The full text consists of four chapters.The first chapter briefly introduces the social background and ideological origin of human rights theory.The second chapter focuses on Sen’s research on the nature and connotation of human rights.First,examine Sen’s understanding and regulation of the essence of human rights and the content of human rights.Secondly,it examines Sen’s understanding of freedom,focusing on analyzing his profound thoughts on the “process aspect” and “opportunity aspect”of freedom and his innovative exploration of the theory of human rights.On this basis,Chapter Three examines the cognitive basis of Sen’s human rights theory:rational consideration.Through criticism of the rational assumptions of mainstream economics,Sen proposed a broad rationality with reasoning and reasonable review as the core.he pointed out that thinking on human rights issues should be based on“neutral”rational thinking.The fourth chapter analyzes the human rights theory of its“capability”and reveals the human rights realization logic contained in its Capability theory.Sen’s human rights theory is not without its flaws.His“integrated”human rights theory takes the“process aspect”and the“opportunity aspect”of freedom as the basic content,but the discussion on the two is inclined.Sen does not pay enough attention to the process of human rights,and his attitude towards the process of human rights is also contradictory.The significance of Sen’s human rights theory is that it provides us with a new and feasible way of thinking about human rights issues. |
