Research On The Incentive Mechanism Of Prison Crime Education Reform In China

Under the guidance of the socialist rule of law,the incentives for criminal education reform are an important way for prisons to exercise their penal powers,and they are an important means for the prison penalty enforcement agencies to motivate criminals to actively reform.Incentives for the reform of criminal education are the prison penal enforcement agencies through the establishment and implementation of criminal incentives,administrative incentives,emotional incentives,social incentives,etc.,to clarify the criminals’ reform orientation,highlight the value preferences of the reform,fully mobilize the criminals’ enthusiasm for reform,and motivate the criminals to reform.Subjective initiative,initiative to achieve repentance performance.Although the incentives for education reform of prison criminals in China have formed a relatively stable model,with the development of society and the rule of law,the prison work in the new era is constantly innovating and developing.The incentive mechanism for criminal education reform also exists in the process of realizing the five major transformation functions.With bottlenecks,it is unable to adapt to the new requirements of prison work in the new era.The main problem is that the criminal incentives of prisoners in China are polarized,the effect of administrative incentives is not obvious,the emotional incentives are too old,the social incentives are simplistic,and the daily incentive effects are not obvious.This is closely related to the obvious theoretical research on the legal system of criminal incentives in China,and it is difficult to provide theoretical guidance for practical application.In order to make up for the gaps in the incentives for criminals as an important part of the field of prison law research,and to solve the institutional problems,this paper is based on the relevant concepts and legal relations of the criminal education reform incentives,and introduces the advanced experience and enlightenment of the extra-field prison criminal incentive mechanism,combined with empirical evidence.The results of the investigation and research focus on the status quo and the main problems of the reform and reform of the prisoner’s education reform in China,and finally put forward the countermeasures to improve the incentive mechanism for the reform of prison criminal education in China.In addition to the introduction and conclusions,the body of this article includes the following sections.The first part of the thesis mainly introduces the incentive mechanism of prisoner education China.Finally,through the analysis of the research significance of the prisoner’s educational reform incentive mechanism,the author puts forward the necessity of perfecting the incentive mechanism for the reform of prison criminal education in China.The second part of the thesis mainly analyzes the incentive mechanism of prisoners in extraterritorial prisons,introduces the historical evolution of foreign criminal incentive research,and studies the legal system of prisoners’ incentive mechanism in the two major legal systems,and introduces the advanced legal system of extraterrestrial prison criminal incentive mechanism.The improvement of the incentive mechanism for the reform of prison criminal education in China can provide lessons for reference.The third part of this paper focuses on the analysis of the status quo and main problems of the educational reform incentive mechanism of prison criminals in China.In this chapter,the author mainly combines the feelings and experience of working in prison for ten years,taking the incentive mechanism of criminal education reform in his own unit as the research object,and taking the current prison system and criminal incentive mechanism as the background,through the criminals of the unit The evaluation of incentive mechanism is conducted by questionnaire survey,and the analogy analysis is based on the terms of criminal sentence,age and crime.The current situation of criminal incentive mode is analyzed,and the existing problems and needs of improvement are clarified,so as to further improve the incentive mechanism for criminal education reform.To maximize its incentive performance.The fourth part of the thesis is the focus of the article.It mainly studies the countermeasures to improve the incentive mechanism of prison criminal education reform in China.Firstly,from the guiding and normative explanation of legal principles,it proposes to improve the incentive mechanism for the reform of prison criminal education in China.Principles,fairness principles,and due process principles;Secondly,from the legislative level,speed up the revision and improvement of China’s current Prison Law,write the relevant criminal incentive system into the law,solve practical confusion,and formulate the Criminals Appraisal Law and Criminals.The Law of the Case and the Law on the Reward and Punishment of Offenders form a unified criminal incentive system and a stable policy,open up the link between the various incentive mechanisms for criminals,form an organic whole,give full play to the ultimate guiding role of commutation and parole,and improve legal protection.With legal remedies,enhance the matching between administrative incentives and legal incentives,enhance the pertinence of the daily incentive system,strengthen the construction of the prison people’s police force,and improve the professional quality and law enforcement level of the prison people’s police.The conclusions of this paper mainly summarize the improvement of the incentive mechanism of prison criminals in China from the practical significance of practice,the enlightenment of advanced experience outside the country,the analysis of current situation,and the countermeasures.Finally,the future prospects of the construction of prison criminal incentive system in China are made.
