| Specific regulations is the national autonomous area the National People’s Congress,within their autonomous right,combining the characteristics of the local political,economic and cultural,regulating social life is one aspect of regulating documents,national autonomous area the National People’s Congress is one of the important ways to bestow autonomous right by the Chinese constitution,and autonomous regulations,flexible rules constitute the national legislation system.Since the implementation of the system of regional ethnic autonomy in China,the legislation of the specific regulations of Yanbian Korean Autonomous Prefecture has been in the forefront of the 30 Autonomous Prefectures in China,and fruitful results have been achieved.However,for various reasons,in practice,the formulation and implementation of specific regulations can not bring about the legislative effect what legislators pursue."The legislative provisions of Yanbian Korean Autonomous Prefecture",which came into effect on April 1,2017,clearly stipulate the post-legislation evaluation.Article 41 " The relevant specialized committees and the operating division of the Standing Committee may organize post-legislation evaluation of the relevant laws or the relevant provisions of laws.A report on the evaluation shall be submitted to the Standing Committee." It marks that the post-legislation evaluation of the specific regulations is gradually on the right track in some ethnic autonomous areas.At present,Yanbian Korean Autonomous Prefecture has preliminarily established the post-legislation evaluation system of the specific regulations,and has also implemented the post-legislation evaluation of some specific regulations,and achieved certain results.However,compared with the post—legislation evaluation of laws and local regulations,post—legislation evaluation of specific regulations is still in the primary stag.Problems do exist with it.For example,there is singularity of what is to be evaluated;the criteria of evaluation is incomplete;its evaluation method is relatively unitary and there has not been formed unified post—legislation evaluation procedure.Therefore,the post—legislation evaluation of specific regulations cannot bring into its full play and the improvement of legislative quality would be impeded.Yanbian Korean Autonomous Prefecture should actively draw on lessons from the experience of post-legislation evaluation of laws and local regulations and other specific regulations of ethnic autonomous areas,and formulate a professional"Post-legislation Assessment Measures for Yanbian Korean Autonomous Prefecture"so as to provide a clear basis for the post-legislation assessment of the specific regulations.Also,it constructs diversified post-legislation evaluation subjects,establishes scientific post-legislation evaluation criteria,comprehensively uses diversified post-legislation evaluation methods,designs complete post-legislation evaluation procedures,and promotes the institutionalization,standardization and legalization of post-legislation evaluation of specific regulations,so as to ensure that the post-legislation evaluation of specific regulations can give full play to the quality of legislation and can promote the development of various undertakings in Yanbian Korean Autonomous Prefecture.First of all,in view of the unclear basis of post-legislation evaluation,Yanbian Korean Autonomous Prefecture should actively draw on the experience of post-legislation evaluation of laws,local regulations and other special regulations of ethnic autonomous areas,formulate a special "Post-legislative Evaluation Measures of Yanbian Korean Autonomous Prefecture",and make comprehensive provisions on the starting time,evaluation subjects,evaluation methods,evaluation procedures and response of evaluation results of post-legislation evaluation of special regulations,so as to provide a clear basis for post-legislation evaluation of special regulations.Secondly,for the single subject of evaluation,it is necessary to build a diversified post-legislation evaluation subject,and combine internal evaluation with external evaluation to ensure the objective and fair evaluation results.Thirdly,in view of the problem that the evaluation standard is not comprehensive,it is necessary to establish a scientific post-legislation evaluation standard,which is divided into five aspects:purposiveness,legality,practicability,national characteristics and cost-effectiveness.Then,to solve the problem of relatively single evaluation method,we should comprehensively apply diversified post-legislation evaluation method,while widely applying qualitative analysis method,increase the role of quantitative analysis method in the evaluation,and pay attention to the public’s participation in the evaluation process.Finally,for the problems that have not formed a unified post-legislation evaluation procedure,a complete post-legislation evaluation procedure should be designed,which is divided into four parts:the start-up stage,the implementation stage,the summary stage and the feedback and application stage of the evaluation opinions.Through the above aspects,we can promote the institutionalization,standardization and legalization of post-legislation evaluation of special regulations,so as to ensure that post-legislation evaluation of special regulations can give full play to the quality of inspection legislation and promote the development of various undertakings in Yanbian Korean Autonomous Prefecture. |
