Analysis On The Autonomy Legislation Of Yanbian Korean Autonomous Prefecture

Yanbian Korean Autonomous Prefecture(hereinafter referred to as"Yanbian State")is one of the earliest established minority autonomous prefectures in China,the only minority Autonomous Prefecture in the three northeastern provinces.The region has a high population of the Korean people,so it is the largest living area of the Korean nationality.And the state' s "Yanbian Korean Autonomous Prefecture Autonomous Regulations" is the first autonomous regulations of all national autonomous areas,including fivee thnic autonomous regions.Since 1985,Yanbian promulgated the first regulations,has been more than 20 years.Relative to other national autonomous areas,Yanbian state autonomy legislation has its own advanced nature,but there are also some problems.This paper attempts to use the constitutional law and administrative law system theory knowledge,and it mainly analyzes the autonomy legislation of Yanbian Korean Autonomous Prefecture.On the basis of elaborating the characteristics of legislation and the effectiveness of legislation in Yanbian state,this paper analyzes the problems in the legislation of Yanbian state,and puts forward the objective proposal of consolidating and improving the autonomy legislation.The thesis consists of five parts,each layer is progressive,and this paper summary analyzes the autonomous legislation of Yanbian state.The first part:Mainly explains the background of this thesis,on the present situation of the legislation of Yanbian Autonomous Region,the research method of the paper,the research purpose and the significance of topic selection.The second part:Starting from the historical evolution of the legislation of the autonomous legislation of Yanbian state,the author expounds the start and development of the legislation of Yanbian state autonomous legislation.This article Mainly introduced the "Yanbian Korean Autonomous Prefecture Autonomous Regulations"and the process of the formulation and revision of 47 separate regulations in Yanbian state.The third part:Making a detailed and objective analysis of the results of the legislation of Yanbian Autonomous Prefecture,and makes a statistical analysis of the legislation of Yanbian from 1985 to December 2016 in the form.On this basis,all the 48 regulations were classified and analyzed,and all the revised regulations were analyzed,and the legislative plan and implementation of Yanbian state 2013-2017(including the revised legislative plan for 2015-2017)were analyzed.The fourth part:On the basis of in-depth interpretation of some of the regulations in Yanbian state,this paper analyzes the characteristics and achievements of Yanbian Autonomous legislation.First of all,Yanbian state autonomy legislation focus on the protection of national characteristics.That is:pay attention to the protection of national language,inheritance of national traditional culture,the development of national traditional sports,the protection of the Korean cultural intangible cultural heritage and local characteristics of resources.Secondly,Yanbian Autonomous Region legislation focuses on the protection of natural mineral water environment,ginseng industry and long Pine resources such as local characteristics.Thirdly,introducing the economic and social effects of the legislation of Yanbian Autonomous Region and filling a number of legislative gaps.The social effects include the protection of the development of Yanbian national culture,deepening the educational work in Yanbian,strengthening the national unity of Yanbian state.The fifth part:introducing the problems of Yanbian state autonomous legislation.That is to say:the lack of national characteristics,copy the upper law;the content of the regulations lag,the amendment is not timely;the depth of the legislation is not enough,the effectiveness is not strong;the provisions of the legal liability is not clear.In view of these problems in the legislation of Yanbian Autonomous County,the paper puts forward the corresponding suggestions.Namely:Yanbian state autonomy legislation should be rooted in the local reality,highlight the national characteristics;get rid of focusing on the number of legislation,lighting the quality of the misunderstanding;strengthen the filling legislation,pay attention to effectiveness;strengthen the accountability mechanism.
