Research On The Presentation Of Legislative Language Of The Social Control Function Of Archives

The construction of archives laws and regulations in our country is in the period of transition from the legal system to the rule of law.The legal system of archives is the premise and foundation of managing archives according to law.Social governance needs to put forward higher requirements for archives law,aiming at better utilizing the social control function of archives to realize the rule of law of archives.The social control function of archives depends on the attribute of the object and the demand of the subject.In the expression of the demand of the social subject,the power subject represented by the state power occupies an absolute dominant position.The archives law,as the transmission tool of the state power,directly carries the social control function of archives.The function of social control of archives is presented through legislative language.The use of legislative language affects the exertion and Realization of the main body’s social control function of archives.There are some imperfections in the development of the legislative language concerning archives,and the legal norms constructed by this legislative language can not maximize the social control function of archives,so that people feel at a loss in the process of implementation.Therefore,the legal regulation of archives has aroused widespread concern from all walks of life,and realized the importance and urgency of perfecting archives legislation.Under the framework of legislative language,this paper tries to explore the intention of social control function of archives within the scope of law,analyze the problems existing in the presentation process of archives legislative language,and think about the optimization of archives legal text.Firstly,this paper defines the concept of legislative language and the social control function of archives.Through the analysis of the problems of the social control function of archives,it finds that it is feasible and reasonable to present the social control function of archives through legislative language.Then it combs the statistics of the current archives law in our country.Based on the legal text,it comprehensively analyses the social control function of archives from four aspects: control consciousness,control activity,control scope and control effectiveness.It is found that in the process of presenting the social control function of archives,there are language ambiguity,ambiguity of words,imprecise logic and improper expression in the legislative language of archives.Sufficient problems,and analyze the factors that affect the use of the legislative language of archives.Finally,in order to strengthen the social control ability of archives and realize the modernization of the rule of law,the paper puts forward the optimization strategy of legislative language throughout the whole process of archives legislation,in order to achieve the accurate summary of the legislative intentions,the correct expression of legislative content and the precise transmission of legislative norms.
