| In recent years,there have been frequent incidents of obstruction of official duties in various law enforcement fields,including the enforcement of tobacco monopoly administration.Such incidents have gradually become the focus of social and media attention,and many news media often push information of obstruction of official duties,causing a certain social impact.Tobacco monopoly administration law enforcement is an important part of Chinese tobacco monopoly system,it regulates the cigarette market order and safeguard the country’s fiscal and taxation income have a vital role,if not effectively solve the problem of disorderly conduct in the process of tobacco monopoly administration law enforcement,so the contradiction between the tobacco industry and cigarette Ling Shou Hu will increase further,rampant illegal behavior will be more involved smoke,tobacco monopoly system will be seriously impact,state tax cannot be guaranteed.Therefore,it is an urgent problem to study the obstruction of public service in the course of tobacco monopoly administration.This paper takes literature method,interview method and questionnaire survey method as the main research methods,and introduces the concept of tobacco monopoly administrative law enforcement from the emergence and development of tobacco monopoly system.Is introduced,the problems of the obstructing,on the other hand,on the condition that the act of resistance in the tobacco monopoly administration law enforcement,impede law enforcement personnel to explain whether the work constitutes obstructing behavior,analysis the characteristics of obstructing problems in tobacco monopoly administration law enforcement,and the problem will what harm to the state,the tobacco industry and society.Through interviews with tobacco monopoly law enforcement personnel,retail cigarette households and questionnaire survey of retail cigarette households,this paper concludes that the problem of obstructing official duties in the enforcement of tobacco monopoly administrative law in chongqing is mainly caused by the following three aspects: first,the reasons of enforcement counterparts,including retail cigarette households,ordinary people and township forces;The e second is the reason for the main body of law enforcement,including the quality of law enforcement,the exercise of personnel rights,the third is the reason for the tobacco monopoly system and the administrative law enforcement environment,including the government and enterprise system,the lack of legislation,reform pilot,negative public opinion.In view of the above reasons,this paper proposes that we should strengthen the legal publicity of tobacco monopoly,innovate the classified management and promote the construction of credit in the aspect of law enforcement counterparts.Law enforcement bodies should establish access mechanisms,raise the level of law enforcement,and enforce strict discipline in law enforcement.In terms of tobacco monopoly system and law enforcement environment,relevant laws and regulations should be improved,public opinion prevention and control should be done well,joint law enforcement cooperation mechanism should be established and other countermeasures and Suggestions should be made to solve the problem of obstructing public affairs. |
