| Illegal use of stimulants has long been a cause for concern.In order to fight against doping crimes and protect the physical and mental health of athletes,the Supreme People’s Court issued a judicial interpretation on the trial of doping criminal cases at the end of last year.The introduction of the interpretation provides a strong guarantee for winning the battle against doping,maintaining fair competition in sports competitions and protecting physical and mental health of sports participants.It is conducive to improving the modernization level of sports governance system and governance capacityand accelerating the construction of a strong sports country.It shows our country’s determination and attitude of responsibility as a major sports country,and resolutely crack down on the illegal and criminal acts of doping.Doping crime brings us a lot of harm,for example,it infringes on the health of citizens,destroys the sports order of fair competition,damages the reputation of the country,and brings great harm to citizens,society and the country.Foreign research on doping crime in sports competition starts earlier and has a higher level than domestic research.Many European countries have developed relatively complete criminal law regulation system of doping crime.Compared with the more mature criminal law regulation system of doping crime in foreign countries,the criminal law regulation system of doping in China is not satisfactory.As the international community calls on Member States to enact relevant laws and regulations as soon as possible to combat the increasing doping crime,China should step up the criminal legislation in this area.In sports competition,the problem of doping crime is the common research topic of sports law and criminal law.The research contents of this paper include: the outline of doping crime in sports competition;the standard of criminal law regulation of doping crime in sports competition;the current situation of criminal law regulation of doping crime in sports competition in China;the criminal law regulation of doping crime in foreign countries and the study in China;the idea of criminal control of doping crime in future sports competition in China.This article will start with the definition of doping crime and focus on the theoretical and practical basis of the criminal law regulation of doping crime.In-depth analysis of China’s current laws and regulations as well as foreign laws and regulations on doping crime regulation.Thus,the criminal law system of doping crime with Chinese characteristics is constructed.In the Constitution and design of the criminal control system of doping crimes in sports competitions,the guiding principles of the criminal punishment of doping crimes in sports competitions are specifically set,which behaviors can be regulated by the criminal law and the types of charges and penalties of doping crimes are explored.Through the systematic study of doping crime,the aim is to restrain the abuse of doping and protect the legitimate rights and interests of athletes. |
