Research On The Reform Of National Supervision System In The New Era

Since the 18 th National Congress of the Communist Party of China,with the rapid development of China’s economy and the improvement of people’s living standards,China has paid more attention to the problem of corruption and taken more resolute measures to solve it.In the face of the current serious corruption,the Party Central Committee decided to promote the reform of the national supervision system,and set up a supervision committee to exercise the supervision power to solve the corruption problems faced by China.In this paper,under the background of the reform of the national supervision system,we use the Marxist theory to analyze the reform of China’s supervision system,point out the existing problems in the current reform of China’s supervision system and put forward suggestions to solve the problems.This paper is divided into three parts.The first part is an introduction to the theoretical origin,background and significance of the reform of the national supervision system.Marx’s classical writers have made a lot of discussions from the two aspects of practice and theory,which is the theoretical source of China’s supervision system reform.Xi Jinping’s new socialist ideology of socialism with Chinese characteristics has further developed from two aspects of practice and theory on the basis of absorbing Marx’s classical theory,forming a supervisory system with China’s characteristics.On the system,the national supervision system in the new era is the product of the combination of the basic principles of Marxism and the reality of our country.The second part mainly explains the problems that still need to be deepened in the reform of the national supervision system,which is divided into three parts.The first is the power restriction of the supervisory committee,which independently controls all anti-corruption resources and establishes a highly centralized supervision system.If there is no supervision and restriction on the supervisory committee,it may face new corruption problems,so the supervision and restriction on the supervisory power is particularly important.The second is the protection of the rights of the monitored object.The protection of human rights is the basic principle of today’s society.The monitored object is at a disadvantage when facing the supervision committee.How to protect the legitimate rights and interests of the monitored object is a problem we should consider.Finally,it is about the problems in the use of lien,mainly including the review of lien measures,the setting of lien places,and the application of lien period.The third part mainly puts forward some suggestions to solve the problems that still need to be deepened in the reform of the national supervision system.First of all,for the problem of power restriction of the supervisory committee,through the establishment of internal and external linkage supervision mechanism,such as strengthening the self supervision of the supervisory committee and the external supervision of the people’s Congress,the judiciary and other aspects.Secondly,for the rights protection of the supervised object,the legitimate rights and interests are protected by giving the supervised object the right to file administrative litigation.Finally,in view of the problems in the application of lien measures,the main way to regulate the place of lien and extend the duration of lien measures is to refine the laws and applicable provisions of the supervision system.
