| In today’s society,big data has become an indispensable strategic resource in the digital economy.Based on the behaviors of abusing the dominant market position and the unique characteristics of Internet enterprises,this paper analyzes the formation mechanism,and further analyzes the influence of the abuse of dominant market position by Internet enterprises is different from the tradition,which not only destroys the normal order of market competition,but also hinders technological innovation and even infringes the legitimate rights and interests of consumers.Based on this,the study on the identification of the abuse of dominant market position by Internet enterprises is the realistic requirement of regulating market competition and the internal requirement of improving anti-monopoly law.In addition,the paper takes a typical case of Google uses its dominant position in the general search service market to intervene in the adjacent shopping comparison service market to analyze the concealment of the abuse of Internet enterprises.At the same time,it also comes to the common and complex problems of identifying the abuse of dominant position by Internet enterprises,including blurring market boundaries,accelerating the emergence of a dominant firm because of network effects,and new technical barriers preventing market entry.Finally,combined with China’s anti-monopoly law on the abuse of dominant market position and the experience of the United States and the European Union in identifying the abuse of dominant market position by Internet enterprises,this paper puts forward some suggestions to solve the problem of Chinese Internet enterprises’ abuse of dominant market position,including perfecting the definition of relevant markets,improving the identification criteria of dominant market position,and judging the abuse of dominant market position by Internet enterprises with the principle of prudence and flexibility. |
