| While Internet economy has active market economy,it also brings unstable factors to market competition.It is common for platforms to abuse their dominant market position in order to compete for limited user resources in the stage of "stock competition",which will obviously damage the market competition and the public interests of consumers and society.Therefore,it is urgent to clarify the identification rules.Although China’s latest anti-monopoly Guide on platform Economy has made breakthrough provisions in some contents,such as "choose one from two" behavior,the identification details and principles involved in it still need to be clear,in order to overcome the ambiguity of application and exert the maximum effectiveness of the guidance function.In addition to the introduction and conclusion,there are four parts to discuss respectively.The first chapter firstly points out the particularity of abuse of dominant market position by Internet platforms and the identification dilemma caused by it,including the influence of the competitive characteristics of the Internet field on the identification rules,and makes empirical reasoning by enumerating the characteristics of bilateral market and stock competition.After a root analysis of the particularity of platform abuse,the paper lays a foundation for the challenges encountered in the identification process.The second chapter is based on the explicit provisions of the Guide,sorting out the behavior and result standards for identifying the abuse of market dominance by Internet platforms,and carrying out reasoning reasoning based on the contents of the punishment decision of "Ali Case",so as to provide reference for forming a complete identification procedure later.The third chapter points out that the innovative provisions of the Guide for identifying platform abuse of market dominance should be applied to the practice of ali Case to guide the specific research of subsequent identification rules.At the same time,even though there are difficulties in practice,it does not affect the fact that the regulation of platform abuse has become an international trend.Legislative practices both inside and outside the domain strengthen the supervision of platform abuse.By summarizing the policy attitude and direction of anti-monopoly jurisdictions such as the United States and the European Union,it can give enlightenment to the refinement of the identification rules in China.The fourth chapter mainly focuses on the Internet platform verification steps of abuse of dominant market position behavior research,including the accurate market positioning,market dominant position that factors of the application of the comprehensive consideration,and the concrete application of legitimate defence system,finally in the form of flow chart will be clearly identified five steps of the path,It is of practical significance for the construction of identification rules in China to innovatively streamline the identification process of Internet platform abuse of market dominance. |
