A Study On The Difficulties In The Renovation Of Illegal Buildings In Residential Communities In L District Of Shenzhen City

With the speeding up of urbanization in our country,urban governance has been effectively promoted,but at the same time it has also brought a series of urban problems.Among them,the emergence of illegal buildings in cities has become a major problem of urban management.A large amount of land has been occupied and public resources have been infringed by the illegal construction.It not only affects the effective implementation of land management policies and undermines the credibility and authority of the government,but also causes blind spots in management,bringing safety risks to residents and harming the ecological safety of the city.It has become a "stubborn disease" that damages the health of the city.The number of illegal buildings in Shenzhen is large and the number of illegal buildings is wide.What’s more,the construction of illegal buildings in the residential areas has become more frequent with the rise of housing prices in Shenzhen.From 2017 to2019,nearly half of the total number of complaints about illegal buildings in district L are related to residential communities.The trend of increasing complaints about illegal buildings in residential communities is more and more obvious,resulting in continuous neighborhood disputes and frequent petitioning and litigation by community owners.Such illegal buildings bring more and more pressure to the government management.In this paper,through literature research,case analysis,interviews and other research methods,the author widely collect government documents,the typical cases of the complaints,news.Furthermore,through symposium and telephone interviews with law enforcement personnel,grassroots cadres,residential community owners,the author comprehensively discusses the current situation of illegal building renovation in residential area of L district in Shenzhen.Starting from the theory of holistic government and the theory of inter-departmental cooperation,this paper analyzes the existing problems and causes of the end law enforcement mode of illegal building renovation in residential communities.At the same time,on the basis of referring to a large number of excellent anthology,papers,periodicals,this paper combs out the domestic and foreign illegal building renovation andput forward countermeasures,in order to provide a certain reference for the residential community illegal building renovation.Through in-depth research,this paper starts from the prevention,control,investigation and execution of illegal buildings in residential communities,and summarizes the difficulties in the renovation of illegal buildings in residential communities,which are mainly manifested in the blind spots of supervision in the prevention and control link,the difficulty in the law enforcement in the investigation link and the difficulty in the compulsory demolition in the execution link.After analysis,the author found that there are three main reasons for the unsatisfactory rectification.First,the linkage mechanism has not been established.Second,the standard law enforcement has not been implemented;Third,the implementation guarantee is still lacking.In view of the above problems and causes,this paper uses the theory of holistic government and inter-departmental cooperation to put forward three feasible suggestions:establishing a joint prevention and control mechanism,ensuring strict and standardized law enforcement,and ensuring strict implementation.
