In the threshold of the 21 st century, Chinese cities are in a critical period of economic and social transformation. While urban and rural economy have witnessed a rapid development, the urbanization process continued to accelerate and urban construction gained great achievements, a spate of issues have emerged as well, one of which is the illegal construction. Illegal construction increases at a fast speed, having become an inevitable auxiliary produc t of urbanization process. Ever-growing illegal construction is not only the “tumor” of urban planning and management, but also the “pain” of government administration. It puts a bad impact on Chinese urban planning and construction, damages urban and rural environment, poses a threat to public interests of Chinese citizens, and exerts a negative influence on social life of the masses.Through research on relevant materials about illegal construction, the author finds some studies are undertaken from the p erspective of administrative laws and some are from the urban planning, Also, the former studies focus on the illegal construction in connecting parts of towns and countries, in countries or in both sides of highways. Nevertheless, few analyses on illegal construction governance are undertaken on the basis of criminal laws by now. Hence, starting with reasons, types and threats with regard to illegal construction, the essay is intended to present a new concept “crime of illegal construction” and discuss the term from five aspects.The introduction part describes research backgrounds, significance, current studies, research methods, main problems and points of difficulty and creativity. Chapter one gives a brief introduction about types, features and causes of illegal construction and status quo of governance, thus the term can be identified more accurately. Chapter two stresses on the punishment deficiency of illegal construction in the framework of criminal laws. Chapter three puts a question whether illegal construction should be defined as crimes. Chapter four proposes to add crime of illegal construction to criminal laws, and offers it a systematic and comprehensive design and positioning.
