Virtually,high-risk and cross-regional characteristics of e-commerce transactions lead to the traditional legal system in the field of e-commerce can not be applied to the conflict.As one u.s.judge argues,attempts to apply existing laws to the internet are as risky as attempts to get on a running bus.In the face of the challenges brought by e-commerce to the legal system of consumer rights protection in our country,combined with the provisions of the e-commerce law on consumer rights protection,this paper analyzes the problems of the legal system of consumer rights protection in the context of e-commerce in our country,such as the lack of precision in the definition of the scope of application of the e-commerce law,the lack of clear provisions in the e-commerce law on the burden of proof system of consumer personal information protection,the ambiguity of the form of responsibility to be borne by platform operators and the difficulties in the application of dispute resolution provisions in the e-commerce law.Comparing and evaluating the legal system of consumer rights protection under the background of e-commerce in EU,UK,Germany and USA,it is concluded that under the background of e-commerce,consumer rights protection should pay attention to perfecting legislation and perfecting the supporting regulations of E-commerce Law.On this basis,it is put forward that perfecting the legal system of consumer rights protection under the background of electronic commerce in our country needs to further improve the provisions of the scope of application of the Electronic Commerce Law,apply the principle of inversion of the burden of proof in judicial trial,clarify the form of responsibility of platform operators and construct an authoritative and efficient dispute resolution mechanism.
