Research On The Legal System Of Construction Project Bidding

With the continuous progress of urbanization in China,the construction project is booming,and the construction industry is booming.At the same time,there are various problems in the bidding activities of construction projects,which highlights the loopholes in the legal system of bidding for construction projects in China.Since the promulgation of the bidding law and the implementation of the bidding system in our country,in the process of continuous practice and application,there are a lot of problems and loopholes in legislation.It is of great significance for the theoretical development of the legal system of construction project bidding to put forward the problems existing in the legal system of construction project bidding and find out the perfect scheme.This paper mainly studies the problems existing in the legal system of bidding for construction projects in China,and puts forward effective suggestions to improve these problems.In the international market,after continuous improvement and development,the bidding system has become a mature legal rule.Most countries have developed a perfect and feasible legal system of bidding.However,due to the fact that the legal system of construction project bidding has not been established for a long time in China,and the interference factors in all aspects,there are still problems in all aspects of the legal system of construction project bidding in China,which leads to the illegal elements using the legal loopholes and seriously undermining the smooth development and orderly operation of the domestic market competition mechanism.Therefore,I hope to improve the legal system of construction project bidding through research,in order to better maintain the steady development of China’s socialist market economy.The significance of improving the relevant legal system of construction project bidding in China lies in ensuring the better operation of bidding activities within the legal limits,eliminating illegal bidding activities from the legal level,and improving the credibility and authority of bidding activities.From the perspective of legislation,while standardizing the bidding activities,it protects the national interests,social public interests and the legitimate rights and interests of the parties involved in the bidding activities,improves the economic benefits and ensures the quality of the project.In the process of writing this paper,we use the research methods of literature,comparative analysis and historical analysis.Through the in-depth analysis of the legal system of bidding for construction projects in China and the comparison with the legal system of bidding for foreign countries,we have made clear the problems existing in the legal system of bidding for construction projects in China,and pointed out the right way to improve the legal system of bidding for construction projects in China.This article also examines the legal system of construction bidding in some developed countries,which provides theoretical support for perfecting our bidding system,taking the essence and the dross,drawing on its reasonable legislative principle and excellent experience,so as to extract and summarize the institutional experience that is suitable for China’s actual national conditions.This paper is divided into five parts to study the legal system of construction project bidding in China:The first part is the introduction.This part mainly introduces the research purpose,significance,research methods,research status at home and abroad,to understand the latest achievements and shortcomings in this field,in order to determine the research direction of this paper.The second part is an overview of the legal system of construction engineering.This part defines the concept and characteristics of construction project bidding,sorts out the relevant legislation of construction project bidding in China,and interprets the significance of improving the legal system of construction project bidding.The third part is the foreign construction project bidding system inspection and reference.This part investigates the bidding system of construction projects in some developed countries,elaborates the contents and characteristics of the bidding system in some developed countries,and learns from its excellent experience.The fourth part is the problems of the bidding system of construction projects in China.This part mainly summarizes the problems existing in the legal system of bidding for construction projects in our country,finds out the existing problems through in-depth analysis of the relevant legal system of bidding in our country,and analyzes and interprets them.The fifth part is the improvement of the bidding system of construction projects in China.This part of the fourth part of the problem,one by one put forward suggestions for improvement.Analyze the causes of the problems and find out the solutions,and strive to improve the legal system of construction project bidding as soon as possible.With the continuous development of China’s socialist market economy and the general trend of global economic integration,throughout the sound legal system of construction project bidding in developed countries,we must keep China’s construction project bidding activities in line with the international development trend,check and fill the gaps in China’s construction project bidding system as soon as possible,find out the existing problems and defects,and continue to In order to ensure the steady development of related activities in the field of project bidding and promote the continuous economic growth of our country,we should perfect this legal,system as soon as possible by means of local legislation and practical inspection.The innovation of this paper is to summarize and refine the new problems that have not been raised in the past academic research on the legal system of construction project bidding.For example,there are some problems in the legislative system,such as the contradiction between laws and the content is not rigorous,and the shallow legal provisions lead to the poor operability.For
