In 2019,the Chao yang District Court of Beijing tried the country’s first “single female egg freezing case”.This case has aroused widespread public concern.This is not the first time that single women’s egg freezing problem has entered the public eye.Jilin Province promulgated the “Regulations on Population and Family Planning” as early as 2002.The regulations clearly stipulate that women who have reached the legal age and are no longer married and have not given birth can use legal medical aids to give birth to a child.The promulgation of the regulations has aroused strong repercussions in academia and society.The newly revised “Population and Family Planning Regulations” in 2016 did not delete this provision.This provision has also become the starting point for discussion on the issue of single women’s freezing of eggs.Single women have a demand for egg freezing due to various reasons.On the one hand,the development of modern society has liberated women from traditional housework,and people have begun to use market-oriented standards to measure women.On the other hand,women cannot get rid of the responsibility of taking care of the family.The higher and higher requirements of modern society on women make women bear more and more pressure,and women will inevitably fall into anxiety.Due to their own physiological structure,women cannot completely get rid of the traditional role of “mother”,and childbirth itself will have a significant impact on women’s work and life.In addition,the change in the concept of marriage has made emotional dependence and companionship the main motivation for marriage,the age of marriage continues to be postponed,and the group of single women continues to grow.According to different purposes,we can roughly divide single women’s egg freezing into three categories.First,freezing eggs for no reason.Single women dominate their bodies arbitrarily.Secondly,egg freezing for preventive purposes,also known as social egg freezing,is the reason why most single women want to freeze their eggs.Finally,women who want to have a single child choose to freeze their eggs according to their actual needs.As a reproductive cell,the egg is an important part of the female body.The essence of modern personality right is to promote the self-improvement and development of personality.As a specific personality right,the core of body right is to promote the personality development of the subject through self-determination of the body.Therefore,the right of single women to freeze their eggs can be an example of the right of body.However,rights are not arbitrary,and the exercise of rights is subject to certain restrictions.The body itself is extremely ethical.Although people have certain positive powers over their bodies,this does not mean that people can control their bodies arbitrarily.The exercise of physical rights is subject to three restrictions.First,security restrictions.This mainly includes the risk of egg freezing surgery and the risk of childbirth in older women.Second,the restriction on the protection of children’s rights.Single birth may lead to a large number of single-parent families,which is not conducive to the healthy growth of children.Third,ethical restrictions.This mainly includes the ethical disputes that single women may face themselves and the ethical issues caused by commercial behaviors such as buying and selling eggs.These three kinds of objections can be used as reasons for restricting the exercise of physical rights,but they are not up to the strength to prohibit single women’s right to freeze eggs.It is of great significance to protect the right of single women to freeze their eggs.In law,taking the right of body as the basic right can avoid the problem of generalization of rights.At the same time,it can also provide a clear legal basis for single women to defend their rights,enrich the content of body rights from the perspective of judicial practice,and improve personality rights.Edit.For female individuals,egg freezing for single women can free women from childbirth,provide women with more choices and opportunities,and maintain female dignity.From the perspective of social development,a diverse social environment can cultivate a spirit of equality among citizens,and make citizens more tolerant and respect others’ ideas and lifestyles.Allowing the existence of different concepts and lifestyles is conducive to the realization of system tolerance,and provides a platform for equal exchange,dialogue and even argumentation for different concepts and values.This is the inevitable requirement of a modern society under the rule of law.
