On March 2,2022,National People's Congress representative Huang Xianhua proposed to guarantee single women's reproductive rights and equal rights for children born out of wedlock,suggesting that the National Health Commission and the Women's Federation adopt policies to allow single women to enjoy the same reproductive rights and benefits as married women.Given China's current population structure,the state has responded positively to the population ageing by encouraging births and promoting long term development of the population,from fewer and better births in the past.However,the post-85 s and post-90 s who are of childbearing age have low desire to have children because of economic pressure,career development and more diversified lifestyles.As China urbanizes and women become more educated,we are seeing an increase in the number of single women in China,most of whom are concentrated in highly educated,high income groups,these single women have a need to have children because of career plans or because they don't want to enter into traditional “Strong and weak”marriages,but because the existing laws and regulations can not be fulfilled.It is clear that this is inconsistent with policies that encourage fertility and with the value of respecting human rights and protecting the interests of minorities.At present,no matter how to define the subject of reproductive right or how to implement it,we can not find a clear answer in the framework of law and system.The imperfect legislation and the uncoordinated system have resulted in many practical problems,such as single women being forced to go abroad to “Freeze their eggs”,different decisions on the dispute of reproductive rights in the same case,single women not being able to enjoy the welfare of reproductive insurance after giving birth,and so on.Only by endowing single women with reproductive rights at the legislative level,guaranteeing single women's reproductive rights at the institutional level,and actively dealing with the difficulties and obstacles that single women face in childbearing,can we better resolve disputes and jointly create a win-win situation at a time when the desire for childbearing continues to be low.
