According to relevant domestic laws and regulations,China has not included egg freezing into the field of human assisted reproductive technology,and has explicitly prohibited medical institutions from providing egg collection services to single women.As a result,more and more single women are choosing to go abroad for egg freezing.In recent years,there have been increasing calls in the society for suggesting the release of single female egg freezing,and the media has repeatedly reported on the social harm caused by the underground black egg market.Some experts,scholars,and professionals have suggested that the state liberalize the fertility rights of single females.Restriction allows single women who meet fertility policies to decide on freezing of their own eggs.This article combines materials from various disciplines such as law,medicine,and sociology,as well as documents and data,to analyze the subjective status of single women's reproductive rights from the perspective of the legitimacy of power sources,the inevitability of historical development,and the advancement of social development.Think about the nature and goal of frozen eggs from an angle,and analyze the theoretical and practical significance of frozen eggs in the single female group in China.This article analyzes and analyzes a series of issues related to egg freezing in single women in China,elaborates the current status and related legislation of egg freezing in single women in China,and points out the social background of egg freezing,a series of social problems and related issues facing egg freezing in China.Legislative status.Two typical cases of egg freezing in China were introduced,and the focus of the dispute involved in the case was analyzed by analyzing the reasons for the judgement,which were expounded from the perspective of whether a single woman can independently enjoy and exercise fertility rights and the legal attributes of eggs.The analysis and demonstration show that we can regard the detached egg as a civil law object,and according to its special attributes,it should be classified as an ethical object.To classify the egg into the civil law,according to the property law and related legal theory,a single woman as the owner of the egg has the right to claim related rights,including an application for egg freezing.Then,from the legislative level and the perspective of social security,specific suggestions are made on how to protect the reproductive rights of single women in China.
