| In recent years,an endless stream of judicial corruption cases and some other controversial cases,such as "Nie Shubin case" and "Li Zhuang case",have triggered the discussion and reflection of the party,the government and the public on the current judicial reform,legal education and other aspects.With the construction of the rule of law in China in full swing,the judicial reform has entered a new stage.Under this background,it is of great significance to study the legal professional ethics education in colleges and universities in both theoretical and practical aspects.Legal career is a lofty cause closely related to people.It is inconceivable for a legal person to be guided by professional ethics standards.In the course of judicial reform,the ethical education of law students has been gradually attached importance to by the party and the state.In July 2015,the "Guidance Training Program for Professional Degree Postgraduates of Master of Law" was formally revised to explicitly set"Legal Professional Ethics" as a required course for the first time.The Opinions on Improving the Unified Legal Profession Qualification System issued in December 2015 required that the investigation of legal professional ethics should be strengthened to make legal professional ethics an important condition for legal professionals to enter the legal profession.In January 2018,the Ministry of Education published the National Standards for Teaching Quality of Undergraduate Majors in Colleges and Universities,which included legal professional ethics,three major substantive laws and three major procedural laws as a required course for core majors.In spite of this,the actual situation of legal professional ethics education in Chinese colleges and universities is still not optimistic.In this paper,the legal professional ethics education of legal institutions in China under the background of judicial reform,analyses the problems existing in the college students’professional ethics education method and its reasons,more developed countries and the area of legal professional ethics problem study and draw lessons from the experience,put forward the improvement of the corresponding countermeasures,in order to find out a effective way to strengthen the legal professional ethics education.This paper mainly adopts three research methods:one is literature analysis method.In the writing process,it pays attention to the collection and arrangement of existing literature and materials,and analyzes and illustrates the research object by combining various relevant documents formulated by relevant departments.The second is the comparative analysis method.By comparing the different attitudes of China and the developed countries and regions to the legal professional ethics education,the author points out the existing problems of the legal professional ethics education in China and draws lessons from the redeeming points of the other side’s legal professional ethics education.The third is the empirical analysis.This paper will study and introduce the status quo of legal professional ethics education in colleges and universities in China in detail,discuss the shortcomings,analyze the causes,and put forward feasible suggestions. |
