Administrative License Standards:the Eixsting Problems And Countermeasures Of The Judicial Police System Of Chinese Courts

On February 28,2019,the People’s Court daily published the Opinions of the Supreme People’s Court on Deepening the Comprehensive Reform of the People’s Court’s Judicial System and the Outline of the People’s Court’s Fifth Five-year Reform(2019-2023).The outline responds to the new demands and expectations for the scientific development of judicial police work under the new situation,puts forward further requirements for the management system of judicial police in the people’s court,and points out the direction for the future reform.However,in practice,as the judicial police department is a marginal department of the people’s court and undertakes some auxiliary work,there are still many problems.At present,the rule of law has been comprehensively promoted and judicial reform has been deepened.Therefore,it is of great practical significance to study the judicial police system of people’s court comprehensively for the ongoing reform of people’s court.In addition to the introduction and conclusion,this paper is divided into four parts:The first part,the basic theory of our judicial police system.The judicial police of the court refers to the judicial administrative law enforcement personnel who are affiliated to the people’s court and armed,and can use special coercive means in accordance with the law to ensure the safety of judicial places and participants in judicial procedures and to maintain the normal order of judicial activities.The judicial police has the characteristics of supporting and guaranteeing functions,judicatory and administrative functions,coercive and armed functions,etc.Improving the judicial police system of the court is helpful to ensure the normal operation of the court’s trial and execution system,to set up a good image of the court and to create a safe trial environment.The second part,by introducing the basic form of the judicial police system in several typical countries abroad,gives some enlightenment to the current judicial police system in China.So it provides some good experience for the development of judicial police system in our country.The third part,analyzes the problems and causes of the judicial police system of our court.According to the current system operation of judicial police of court,its content has fallen behind the demand of current trial situation,which is mainly reflected in five aspects: first,the contradiction between judicial police force and police task is prominent;Second,the "formation management" system of judicial police has not been effectively implemented;Third,the access channel of judicial police personnel is not smooth;Fourth,the judicial police lacks effective incentive mechanism;Fifth,the personal security mechanism of judicial police is not perfect.The fourth part,some countermeasures to improve the judicial police system of our court.On the basis of summarizing the existing problems and analyzing the causes of the current judicial police system,this paper puts forward some countermeasures for the judicial police system of the court,including: first,to establish a practical vertical leading organization system;Second,the judicial police standardized formation management;The third is to improve the judicial police system;Fourth,the establishment of a provincial-level unified recruitment distribution system;Fifth,to enhance the professional level and comprehensive quality of the judicial police force;Sixth,the establishment of the judicial police level by level election work system.Seventh,establish the survival of the fittest performance evaluation system.
