Thoughts On Improving The Work Of Public Security Letters And Visits

In 1995,the state council formally promulgated the regulations on complaint reporting,which is the first administrative regulation on complaint reporting in China.The development of public security petition work in China today is no longer just our traditional sense of the kind of receiving,sending letters.It has completely become an important line of defense to solve the prominent problems reported by the public in the field of public security.The complaint reporting departments provide Windows and necessary opportunities for the CPC central committee and people’s governments at all levels to deeply understand the prominent problems in the contradictions among the masses.The public security complaint reporting is an important bridge between the public security departments and the people’s vital interests,and it is also considered as an important touchstone for the people to report that the public security departments at all levels serve the people’s vital interests.Various provinces,autonomous regions has issued its own public security regulations according to the regulations made by the State Council.The main purpose of the author’s research on the legalization of the regulations on complaint reporting in public security departments is to enable the public security complaint reporting workers at all levels in China to open up various channels and ways to relieve the people of complaint reporting in addition to the public security administrative reconsideration,administrative litigation,duty crimes and public security law enforcement supervision.We need to give full play to the functions of petition in complaint,suggestion,criticism,so that the public security departments at all levels in the country can improve their credibility,and the people have a greater sense of political security and social trust in petition.The core connotation of the modern rule of law is to pursue social equity and justice,which is also the practical purpose of the rule of law.Public security letters and visits can provide public services,protect people’s personal safety,personal freedom,legal property and social public property from the aspects of timely correction,supervision and promotion,guidance and education of public security work.It can also help public security organs to establish a more pure,just and legal public security team.This paper,from the perspective of studying the demands of handling cases of public security complaint reporting in c city,makes a statistical analysis of the handling cases of public security complaint reporting in the whole year of 2019 in c city and the data and situations of complaint reporting related to police complaint reporting business.In essence,the problem of public security complaint reporting is the problem of handling cases and enforcing laws.The low cost and low threshold of complaint reporting make it difficult to curb the tendency of the petitioners to "not believe the law".However,nine out of ten cases concerning the handling of complaint reporting involving the local public security departments are related to the enforcement and handling of cases by the local public security departments.Only when the law enforcement and case handling departments of the public security departments handle criminal and administrative cases in place,take the initiative to perform their duties,actively regulate law enforcement activities,and eliminate acts of omission,disorderly acts and negative acts,do the parties to the cases or other family members and friends have no need to go to petition,and completely solve the contradictions and hidden dangers that may occur in the complaint reporting from the root and source.The public security departments should focus on the work links that are easy to cause complaint reporting,such as criminal case filing,case solving,administrative case accepting and case handling,strictly check the handling of cases in cases of inferior quality,and strictly supervise the handling of cases by public security departments in accordance with the law.In particular,the public security departments should strictly handle the cases of serious personal accidents that are easy to cause petition,such as intentional injury and other criminal cases of illegal crimes and financial fraud,as well as pouring insist on crack down on illegal crime prevention and control of combining,adoption law enforcement standardization construction.As long as we continue to crack down on crimes,promote the standardization of the law enforcement system of public security departments,and further improve the awareness and quality of case handling personnel and policemen in handling cases in accordance with the law and standardizing law enforcement,the problem of public security complaint reporting will be fundamentally and effectively solved.In the current stage of China’s rapid economic and social development,the development pattern of interest contradictions is constantly changing and adjusting,contradictions and interest conflicts are increasingly intensified and increased,people’s petition appeals are increasingly fierce,and the development situation of petition is more serious.According to the party central committee and the state council on the "lettersand visits into the track of the rule of law" major reform decisions and arrangements and work requirements,task of public security of letters under rule of law is very difficult.The key to promote the legalization of public security complaint reporting in China is to establish and perfect the legal relief and guidance mechanism of public security complaint reporting.In the legal relief work,such as receiving and handling police tasks,handling cases through law enforcement and receiving public security complaint reporting,we should continue to focus on guiding the people to address their complaint reporting appeals through the channels of proper application of laws,and actively strengthen guidance,create opportunities,and prevent the misuse or illegal abuse of the procedures of public security complaint reporting to solve problems.At the same time,public security departments should further improve the public security administrative review,compensation claims,application for medical identification and identification of major traffic accidents and other legal relief channels,so as to effectively facilitate the public,improve the quality and efficiency of public security complaint reporting work.
