| Community correction,as a way of penalty execution that pays more attention to the social attributes of criminals,has been paid more and more attention under the background of criminal policy of combining leniency and severity.It has advantages that imprisonment punishment does not have,which not only saves the judicial cost,but also is more conducive to the return of criminals to normal life.Community correction system,as a "take" system,is not acclimatized in the process of integration with local legal system,and there is a certain gap in development status between urban and rural areas and regions.However,with the introduction of Community Correction Law,grass-roots community correction institutions are constantly standardizing and improving.At the same time,the grass-roots procuratorial organs,which perform the supervision function of community correction work,have many problems in supervision concept,establishment and staffing of institutions,connection of law enforcement organs,supervision methods and supervision means.At present,the community correction system is facing a historical development peak,and the procuratorial organs must keep up with the pace of The Times,take the initiative,make a systematic summary and study of the procuratorial supervision of community correction,grasp the main problems and enhance the supervision ability,so as to promote the healthy and orderly development of community correction work.The author finds that there are many scholars who study the community correction system,but there are few researches on the inspection and supervision of community correction.As himself in the procuratorial supervision of community correction of procuratorial personnel at the grass-roots level,combined with the problems found during the daily supervision,combining with the existing laws and regulations,to think outside the community correctional system,through the literature research and study on the sample mode is analyzed and discussed,in order to grassroots community correction of procuratorial supervision system in our country the beneficial reference.This paper mainly includes five parts:The first part is the introduction of the thesis,which firstly introduces the research background and significance of this thesis.Secondly,the research status of community correction supervision at home and abroad and the viewpoints of major scholars in this field are summarized.Finally,the research methods and innovations of this paper are introduced.The second part introduces the foundation of community correction inspection and supervision.Firstly,the status quo of community correction in China is introduced.Secondly,the legal basis of carrying out community correction by procuratorial organs is expounded.Thirdly,it introduces the main contents and characteristics of community correction inspection and supervision.Finally,the necessity of community correction inspection and supervision is introduced.The third partinvestigates the mature community correction system and supervision methods represented by Japan,New Zealand,The United Kingdom and the United States.By introducing the advantages of community correction supervision in various countries and further grasping the development trend of community correction system,this paper analyzes the concept and emphasis of procuratorial organs on community correction supervision,and brings enlightenment to the improvement of community-level community correction supervision mechanism in China.The fourth partselects JZ County in Hebei Province with moderate economic development as the research sample,analyzes the current situation of community-level community correction,and analyzes the problems and causes of community-level community correction procuratorial supervision from the aspects of personnel allocation,case type and supervision means.The fifth part,according to the problems found in the practice of community-level prosecutorial supervision of correction,puts forward the ways to improve community-level correctional supervision from the aspects of supervision concept,team construction,supervision mechanism,construction of big data supervision platform and strengthening the rigidity of supervision. |
