Research On The Improvement To The Provincial Supporting Legislation Of The Law Of Regional Ethnic Autonomy

The effective implementation of the "Law on Regional Ethnic Autonomy" is inseparable from the guarantee and support of the provincial supporting system.Provincial-level supporting legislation is an indispensable part of the system of ethnic regional autonomy.According to incomplete statistics,various provinces,autonomous regions,and municipalities have successively promulgated 71 local regulations and 12provincial-level government regulations to implement the "Regional Ethnic Autonomy Law." These local laws and regulations have played a role in promoting the effective implementation of the "Law of Regional Ethnic Autonomy." However,due to problems such as lagging legislative concepts and backward legislative technology,these local laws and regulations did not deeply integrate local realities,and did not respond to the supporting legislative requirements of the "Regional Ethnic Autonomy Law" for local laws and regulations.The purpose of relevant local laws and regulations is not clear.There are many overlapping clauses of the "Regional Ethnic Autonomy Law" or mutual overlapping clauses,and there are few "supporting" regulations based on local actual conditions.The "matching" value of local regulations is weak.The provincial-level supporting legislation of the "Regional Ethnic Autonomy" in the new era has both the new functions of promoting the forging of the Chinese nation community and realizing the great rejuvenation of the Chinese nation.This article puts forward a new idea of strengthening the quality of supporting legislation at the provincial level from following the constitutional amendments,basing on regional realities,insisting and improving the system of ethnic regional autonomy.That is,supporting legislation must focus on the consciousness of the Chinese ethnic community,respect the actual conditions of ethnic autonomous areas,Only by coordinating the differences of interests and grasping the two core relationships of the ethnic regional autonomy system can we improve the lack of supporting legislation,and then fully implement the "Regional Ethnic Autonomy Law."...
