China is both a land and maritime power with extensive strategic maritime interests.Maintaining the order of Marine management and realizing the healthy and stable development of China’s Marine industry are the due meaning of building a maritime power.As a traditional crime that infringes the maritime governance order of various countries,drug smuggling by sea has seriously threatened China’s Marine governance system and national security,and the drugs smuggled into China have also brought great damage to the safety of people’s lives and property.Therefore,research on Marine drug smuggling crime,maritime law of the development of the characteristics and development trend of drug smuggling crime,can help us explore crackdown on drug smuggling crime and combat sea point,thus has more investigation puts forward countermeasures,to guide our country drug smuggling crimes investigation activities at sea is of important theoretical and practical significance.This paper takes the criminal activity of drug smuggling by sea in China as the research object,systematically studies the development law and investigation countermeasures of the criminal activity of drug smuggling by sea.Specifically,this paper is divided into six parts.The first part is the introduction.This part mainly elaborates the background,significance,research content and methods of this research,combs the relevant theoretical basis,defines the concept,and lays the theoretical basis and research framework for the follow-up research.The second part is the origin and development of the problem of drug smuggling by sea in China.In this part,the origin and development of the problem of drug smuggling by sea in China are sorted out in chronological order,and various threats brought by the problem of drug smuggling by sea are expounded.The third part is the characteristics of the current drug smuggling problem in China’s sea.This part summarizes the characteristics of drug smuggling at sea through the collection of drug smuggling cases,data analysis and field research,and discusses the characteristics of drug smuggling at sea from smuggling routes,personnel characteristics and means and methods of crime.The fourth part is the investigation difficulty of drug smuggling by sea in our country.Based on the research and analysis of the above part,this part combs and analyzes the existing problems in the investigation of maritime drug smuggling crimes in China through interviews and other methods,and obtains the difficulties and key points in the investigation,which lays a foundation for the research of investigation countermeasures.The fifth part is the investigation countermeasure of drug smuggling by sea in China.This part combines the characteristics and difficulties of investigation of such crimes studied in the foregoing part to put forward targeted investigation countermeasures and suggestions.Mainly from the domestic and international two aspects of the relevant investigation countermeasures.At home,we should strengthen position control and improve the level of intelligence collection in basic investigation work,and put forward relevant optimization suggestions on the application countermeasures of investigation measures such as delivery under control,intelligence collection and public investigation.The international aspect strengthens the international cooperation of maritime drug enforcement,improves the international cooperation mechanism and law enforcement cooperation method of maritime drug enforcement,and targets the crime of drug smuggling at sea,in order to enhance the investigation efficiency of drug smuggling at sea.The sixth part is to summarize the whole paper,sort out the research conclusions,and put forward the shortcomings of this paper and future research prospects.
