Research On The Legal Problems Of The Construction Of Smart Court In Chinan

In order to adapt to the development of the information age and comprehensively promote the reform of the judicial system,the People’s Court has launched the construction of smart courts in recent years.In 2015,the Supreme People’s Court first proposed the construction of smart courts,and in 2019,President Supreme People’s Court Zhou Qiang proposed the comprehensive construction of smart courts during the national two sessions.In recent years,in order to build an intelligent court,the National Court system has taken the construction of an intelligent court as a priority task,and the construction of court information has been constantly pushed forward,the parties involved in litigation are more convenient,judicial power is more standardized,judges are more relaxed,judicial management is more scientific,and the construction of smart courts has achieved remarkable results.After our country authority organization appraisal,our country intelligence court construction is in the international leading level.This article focuses on discussing the development status of domestic smart courts,studying many system problems encountered during the construction of smart courts,and looking for suggestions for optimizing and improving the system,and continuously accelerating the construction of smart courts.The first part of this article describes the research background and significance of the topic,and provides a basic interpretation of the current research conclusions on smart courts at home and abroad.From the requirements of judicial system reform and the level of informatization construction in the new era,it is pointed out that the intelligent court is the general trend of the court information construction in China.In this paper,domestic and foreign scholars in the Smart Court of the status of research,for China’s judicial practice in the construction of the smart court to provide reference to the way and information.The second part of this article summarizes the construction of intelligent court.This part puts forward the concept and essence of smart court,analyzes the relationship between Smart Court and Internet court from two angles of difference and connection,and puts forward the construction target of smart court in our country,that is,business management network,sunlight,intelligence,scientific decision-making.The third part of this article is the history and present situation of the construction of the smart court in China,mainly introducing the history and present situation of the construction of the smart court,the Model of Realizing Intelligent Litigation,intelligent service,intelligent mediation,intelligent court hearing,intelligent publicity and intelligent execution is basically constructed.The fourth part of this article is our country intelligence court construction existence system difficult problem.By analyzing several important links in the construction of the intelligent court,such as the electronic service,the Internet court hearing and the network execution,etc.,this paper expounds in detail the defects of Electronic Service,Internet court hearing and network execution in the construction of intelligent court.Through the deep research on the above problems,the author explores the way to perfect the construction of the intelligent court and finds the applied countermeasures to solve the problems.The fifth part of this article is our country intelligence court should perfect system conceives.This paper discusses how to construct the electronic service system,the Internet court hearing rules and the network execution mechanism,and through perfecting the relevant legal systems,rules and mechanisms,the smart court can better and more strongly exert its own value in the judicial
