Research On Food Safety Supervisiony Of The Third Party Platform

China’s Internet ordering industry develops rapidly and plays a huge role in facilitating life and promoting economic development,but at the same time,the food safety problem of online catering is prominent.In terms of online catering food safety supervision,there are limitations in government supervision.Therefore,the law gives the third-party online catering platform the right of food safety supervision to make up for the deficiency in government supervision.However,in practice,the third-party online catering platform does not fulfill the supervision obligation of food safety.Therefore,in order to guarantee the food safety of online catering,how to improve the food safety supervision of the third-party platform of online catering is worth our in-depth study.This paper starts with the definition of the core concept of food safety supervision on the third-party platform of online catering,and first analyzes the necessity and feasibility of food safety supervision on the third-party platform of online catering.Secondly,the legislative and practical status quo of food safety supervision on third-party online catering platforms in China were summarized,and the existing legislative problems were analyzed,including unreasonable regulatory obligations,light regulatory responsibilities and lack of incentive system.The paper also analyzes the practical problems,including lax examination of network qualification,weak supervision measures,imperfect credit evaluation mechanism,unimpeded channels for complaints and reports,improper handling of food safety accidents,etc.Finally,the author puts forward the path to improve the food safety supervision of the third-party platform of online catering.On the one hand,the author improves the relevant legislation,which includes: setting up the supervision obligation of the third-party platform reasonably,increasing the punishment for the violation of the third-party platform,and establishing the incentive system;The second aspect is to strengthen the effectiveness of third-party platform supervision,including: strengthen the network entry qualification examination,strengthen key monitoring,improve the credit evaluation mechanism,unimpeded complaints and reporting channels,improve the food safety accident disposal mechanism;The third aspect is to improve the relevant supporting measures,including: improving the information sharing mechanism,strengthening the supervision of the third-party platforms,and strengthening the publicity and education of consumer rights protection.
