| Public-private Partnership(hereinafter referred to as PPP)is a new model applied in the field of public infrastructure.Different from the previous financing model,the main participants of PPP are government departments and private enterprises.Both parties have reached a common goal of financing public infrastructure and services.At present,the application of PPP on a global scale expands unceasingly.In China,PPP is at the early stage of rapid development.Due to the imperfect legal system,the lack of responsibilities of regulatory authorities,the excessive intervention by government agencies,and the shortcomings of the financing model itself,there are many potential defects in the development of PPP in China.To solve these problems,it is necessary to carry on the theoretical research and legal perfection.Private Finance Initiative(hereinafter refer to as PFI)has a 30-year history of development in Japan,and it has been continuously improving in many aspects,including legislation,policies,and support regulations.Japan’s FPI law is a strong guarantee for the third sector of Japan to get out of the predicament and the healthy development of PFI,which has reference significance for the development of PPP in China.The article is divided into three parts as a whole.The first part summarizes the background of Japanese PFI law.First introduced the concepts of the third sector,PPP and PFI,and analyzed the relationship between these three from different perspectives.Then it explained the current unique development model of Japan’s PPP and the essential similarities between its third sector and China’s current PPP comparison.And from the perspective of historical development,it studies and analyzes the reasons for the decline of the third sector in Japan and the development of PFI.The second part mainly sorts out the core content contained in the Japanese PFI Law.The PFI law is divided into three stages: project establishment,bidding,and implementation.Focus on the key content of the Japanese PFI Law: operating rights and specialized support organizations-Private Fund Utilization Business Promotion Agency Joint Stock Company.These are missing in our country’s PPP projects,and they deserve our attention and consideration.The third part analyzes how our country should learn from the Japanese PFI development model.After summarizing and analyzing the basic situation of my country’s PPP development model and related legislation,find out the problems that exist in the practice of my country’s PPP related laws,and conduct the development of my country’s PPP with Japanese PFI in terms of operating rights,third-party institutions,and operating methods Compare,find out the similarities and differences,and then put forward relevant development suggestions. |
