On The Administrative Legal Responsibility Ofcivilservants’ Violation Of Family Virtues

After the civil servant law was revised in 2018,family virtue behavior was formally incorporated into the code of conduct of civil servants,requiring civil servants to play a pioneering role and abide by the family virtues of the Chinese nation.Civil servants who violate family virtues will be punished by law,which further improves the moral requirements of our country for civil servants.But combined with the specific relevant laws,we will find some problems,such as the relevant legislation for family virtue behavior judgment standard is vague,there is no a relatively scientific and reasonable reference,civil servants violate family virtue behavior of the plot discretion standard is missing,and in the violation of family virtue behavior of administrative legal responsibility for a series of procedures We still need to analyze and discuss the problem.This paper is divided into three parts,the first part,from the ethical literature and related legislative literature to find materials,define the ethical connotation and normative connotation of family virtue and related theoretical basis;the second part,from the current legislative situation of our country,combined with the case analysis of the current lack of administrative legal responsibility of public servants who violate family virtue;the third part,put forward the current responsibility Suggestions for the improvement of the accountability system are to make clear requirements for the family virtues that civil servants should abide by,to formulate a unified discretion standard for violations of family virtues,and to refine and improve the relevant accountability procedures.
