The catholicity of the administrative power function comes to a decision that the administration according to law is the important composing of the administering a country according to law. In practice and study, our attentions are put on the administrative law subject, however, administrative power is exercised by civil servant, and for, discussing civil servant's administration according to law has more practical significance. Looking from the adjustment mechanism of civil servant system, the right of civil servant is the internal institutional causation and the responsibility of civil servant is the exterior institutional causation that urge civil servant to exercise the administrative power according to law, which has been proven by the require of discretion because of the society's development, the internal motility of civil servant system's adjustment mechanism and the reformation trend of many countries' civil servant system. In our country, the system's driving factor that urge civil servant to exercise the administrative power according to law has the absence of constitutionality construction , its absence, on the one hand , rests with the consciousness that dreaming up the system , this paper discusses the design of civil servant's humanity , whose impersonal and reasonable orientation is the precondition to construct the system's driving factor; on the other hand, rests with the system self, namely, the system's foundation, development and perfection. This paper gets gonging from the actuality of the right and responsibility of civil servant, and only aims at the problems of its constitutionality construction; the writer brings forward his suggestion.
