| The year of 2021 marks the centenary of the founding of the Communist Party of China.In the past 100 years,the Communist Party of China has carried out remarkable exploration of marriage law based on its revolutionary tasks in different historical periods,and achieved remarkable results.The evolution of the marriage system is actually the epitome of an era.The marriage system of each era is not only the concept expression of the system itself,but also the value choice made by the social development.The Communist Party of China attached great importance to the development of the marriage system in China at the beginning of its founding.During the period of the New Democratic Revolution,it formulated a large number of laws and regulations beneficial to women to improve the status of women and realize the reform of the marriage system,which accumulated experience for the first marriage law after the founding of New China.In the period of socialist revolution and construction,the Communist Party of China established the new democratic marriage system,defined the marriage principles of equality between men and women,monogamy and so on,and realized the transformation of the marriage legal system from the traditional to the modern.During the period of reform and opening up and building socialism with Chinese characteristics,the communist party of China to the marriage law has carried on the omni-directional revision,marriage law amendment to marriage law in 1980 to2001 to 2020 years of marriage and family,to expand the protection scope of marriage legal system,strengthening the construction of the marriage law of moral,consolidate and perfect the connotation of the marriage law provisions.In this as long as 100 years of time,the Communist Party of China continues to analyze and summarize the development of the rule of law of marriage in China,constantly looking for the development direction of the rule of law of marriage and family,and constantly promote the development process of the rule of law of marriage in China,so that the rule of law of marriage in China is becoming more and more perfect.This paper will explore the development context of the marriage rule of law from the establishment of the Communist Party of China,elaborate the development and change of the important system of the marriage rule of law in each period,summarize its theoretical value and experience of the rule of law,in order to provide useful reference for the construction of the marriage rule of law in China.This paper mainly includes six parts: The preface mainly expounds the background and significance of the topic,the research status of this topic at home and abroad,as well as the research ideas and methods of this paper;The first chapter discusses the legislative status and theoretical achievements of China’s marriage legal system during the period of the new democratic revolution.The second chapter discusses the formation of the basic framework of China’s marriage legal system in the early period of socialist revolution and construction,as well as the supplementary content of the marriage law in the development process.The third chapter discusses the reform and innovation,change and development of China’s marriage legal system and the institutional changes in the era of marriage and family in the period of reform and opening up and construction of socialist characteristics.The fourth chapter comprehensively discusses the development and changes of the marriage legal system since the establishment of the Communist Party of China,summarizes the experience and enlighten thinking;The conclusion part mainly looks forward to the marriage and family system of our country,especially under the background of The Times when our country is constantly releasing great potential and powerful momentum,our marriage and family system needs to establish a clear and firm value standpoint. |
