Exploration And Inspiration Of The Rule Of Law In The Hundred Years Of Real Right Of The Communist Party Of China

2021 is an important year for the Civil Code of the People’s Republic of China to be formally implemented,coinciding with the centenary of the founding of the Communist Party of China.Since the beginning of the founding of the Communist Party of China,the exploration of the rule of law in real right has made the system of rule of law in real right of our country complete the leapfrog construction and development from scratch,from old to innovation,from part to system.The Communist Party of China closely revolves around the revolutionary,construction and reform tasks of different historical periods,always bearing in mind the interests of the people in the first place,always adhering to the socialist road with Chinese characteristics,and constantly exploring the rule of law in real rights with Chinese characteristics.This paper will be divided into five parts to explore the rule of law of the Communist Party of China in a hundred years.The introduction mainly discusses the background,significance and domestic research literature review of the exploration of the rule of law of real right in the 100 th anniversary of the founding of the Communist Party of China.The first chapter analyzes the exploration of the rule of law of real right carried out by the Communist Party of China in the period of the new democratic revolution.The core of this stage is the change of land ownership.The Communist Party of China led the people through the period of the Great Revolution,the Agrarian Revolution,the War of Resistance against Japan and the War of Liberation,and finally established the land ownership policy of "the tiller has its own land" policy.The second chapter studies the exploration of the rule of law of real right of the Communist Party of China in the period of socialist revolution and construction.At this stage,the exploration of the rule of law of real right by the Communist Party of China makes the country and collective become the main body of land ownership,thus laying the foundation of our socialist economic system.The third chapter discusses the exploration of the rule of law of real right in the new period of reform and opening up and socialist modernization.The reform and opening up has brought new opportunities and challenges to the country and the people.In this new historical period,the Communist Party of China focuses on constructing and perfecting the system of usufructuary right and security right,which greatly enriches the connotation of property law in China.Under the historical orientation of socialism with Chinese characteristics entering the new era,the implementation of the Civil Code of the People’s Republic of China makes the system of rule of law more complete,and the property Law has also become an important part of it.The fourth chapter summarizes the enlightenment of the century-old real right rule of law of the Communist Party of China.From the blank of real right rule at the beginning of the founding of the Party to the detailed compilation of real right now,in this 100 years,the Communist Party of China has carried on the arduous exploration of the rule of law.The valuable concept of rule of law and the practice of rule of law in different stages are worthy of our deep thinking and review.This paper summarizes the excellent legal experience of the Communist Party of China for 100 years and contributes to the strength of property law for the construction of a socialist country ruled by law with Chinese characteristics.
