The system of paid annual leave is an important part of the system of workers’ rest and leave.It is a basic right of workers and is inseparable from their life.The Constitution and labor law of our country stipulate the right of paid annual leave of workers on a macro level.In order to better implement the paid annual leave system,the State Council promulgated the regulations on paid annual leave for employees,which was formally implemented on January 1,2008.The promulgation and implementation of the regulations marked the formal establishment of the paid annual leave system in China.On September 18 of the same year,the Ministry of human resources and social security promulgated and implemented the measures for the implementation of paid annual leave for enterprise employees.The implementation measures for paid annual leave of enterprise employees is a further refinement of the regulations on paid annual leave of employees,which effectively guarantees the implementation of the regulations on paid annual leave of employees.In addition,Hunan,Gansu,Heilongjiang and other places have successively issued the implementation rules of paid leave in government organs and institutions.Thus,in form,the constitution,laws,administrative regulations,departmental rules,and some local government regulations of our country have related provisions on the paid annual leave system,which constitutes a relatively complete legal protection system in form.The notice of the general office of the State Council on printing and distributing the outline of national tourism and leisure(2013-2020)was issued on February 18,2013 by the Chinese government website,which clearly puts forward that the paid annual leave system for employees will be basically implemented by 2020.On March 21,2015,the CPC Central Committee and the State Council issued the"opinions on building a harmonious labor relationship",emphasizing the need to effectively protect the rights of workers’ rest and vacation,and urging enterprises to arrange workers’ rest and vacation according to law.It is necessary to effectively protect the right of workers to rest and vacation,and urge enterprises to arrange workers’ rest and vacation according to law.However,through the relevant investigation,we can find that the implementation effect of paid annual leave system is not satisfactory,and there are many obstacles in the process of implementation.Therefore,in the current context of building a harmonious labor relationship society,how to better solve these obstacles,so as to promote the real implementation of the paid annual leave system has become an important issue.Through case type analysis,this paper analyzes the relevant laws,regulations,local rules and policies,and makes relevant research from the aspects of labor remuneration,subject and legal responsibility of the paid annual leave system,so as to further put forward the implementation suggestions of improving the paid annual leave system of enterprise employees.
