Research On The Governance Of Complaint Letters And Visits In Yangling Demonstration Zone

Letters and visits are an important way for the party and the government to contact,grasp and understand the sentiments of the people,and they are the important measure to address contradiction and maintain the stabilization of the society.With the acceleration of“Jural China” progress,people’s anticipation for normalizing law,as well as yearning for fairness and justice is ever increasing.Under this background,law and litigation involved letters and visits have gradually gone up,which occupies high proportion in all cases relating to letters and visits.The governance of law and litigation involved letters and visits concern establishing judicial authority,comprehensive implementing the basic strategy of law-based governance of the country,stabilizing the overall economic,political and social situation,and improving the social governance capability.Yangling Demonstration Zone was originally an agricultural town.The recent 20 years have witnessed the rapid economical development.Nevertheless,various conflicts and disputes have increased simultaneously.Because 70% of local residents have a low level of education,they tend resolve their own demands through petition.Part of lawsuit-related petition cases are inherently difficult to resolve,and the proportion of petition of bypass the immediate leadership and repeated visits is high,which is likely to cause social instability.The high level operation of law involved petition cases have aggravated the contradiction of the large quantities of cases,and lack of staff in local political and legal agencies,restricting the standardization of law enforcement and judicial work,which in turn triggers new law-involved petition cases,and falls into a malignant circle.law and litigation related letters and visits pose a severe challenge to social governance,and it becomes a major problem the grassroots faced with that needs to be resolved urgently.In this research,we found several problems in Yangling Demonstration Zone,for instance,lack of coordination and communication mechanism among political and legal agencies,insufficient supervision of law enforcement,low level of information and lawsuit resolution,and unconspicuous termination of withdrawal by literature review,questionnaire surveys and in-depth interviews.The analysis combining the theory of social safety valve and the theory of government by law indicated that these problems were restricted by the special administrative system,the ineffective supervision of law enforcement,the weak power to resolve the law-related complaints,and the lack of motivation to terminate in accordance with the law.According to actual situation of the Yangling Demonstration Zone,and referring experience in other governance zone,7 countermeasures like improving the law-related and litigation liaison and coordination work mechanism,formation of joint force for law enforcement and supervision,social third-party intervention mechanism perfection,strengthening source governance,establishing the concept of the rule of law for petitioners,terminating law-related complaints in accordance with the law and complaints and improving the informatization level of governance work were posed.The concept of petitions involving law and litigation was new,and our country paid little attention on it.However,the issue of law and litigation involved petitions is complicated and difficult to address,which poses a great challenge to the social governance of the government and political and legal institutions.Herein,we put forward countermeasures for the governance of law-related complaint letters and visits,hoping that it will play a certain role in reducing the stock of law-related complaint letters and visits in Yangling Demonstration Zone and other areas,controlling their increase,and standardizing and improving the governance mechanism of this problem.
