The rights to employment is the basic rights for citizens to maintain production and life.Due to the influence of physiological, social and cultural factors during the historical process,it is difficult for women to enjoy the same employment treatment as men.In addition, the implementation of the comprehensive two child policy has aggravated the gender discrimination in the workplace and affected the implementation of female workers’ equal employment rights. In order to change the unfair social phenomenon, the Chinese government should update and improve the relevant policies and systems according to the change of fertility policy. It can also ensure the successful implementation of the two child policy. This paper attempts to take the adjustment of China’s fertility policy as an opportunity and starts from the basic principle of equal employment rights.Under the background of the two child policy, through the analysis of data and cases,we find the current situation of the protection of equal employment rights of female workers in China. The phenomenon includes blocked career advancement for women, difficulty in renewing labor contacts and inadequate reproductive welfare.According to the phenomenon, the paper identifies the causes of employment discrimination. On the basis of learning from the advanced experience of Britain and Sweden, this paper puts forward some suggestions to protect the equal employment rights of female workers in China, effectively protects the legal labor rights and fair competition opportunities of women in the workplace, and protects the realization of women’s self-value in the new era.
